3. Background Residency Determination Service
Session Law : directed the UNC, NCCCS, NCICU, and NCSEAA to create a centralized, uniform process for determining residency for tuition purposes and for administration of State-funded financial aid.
Session Law : NC State Education Assistance Authority is key responsible entity, advised by Higher Education Collaborative Advisory Committee (HECAC) -- NCCCS, UNC, NCICU, SEAA, and CFI
Confirms that certain state agencies will provide data base matches with RDS to validate the data of students and parents claiming NC residency

Students use one residency determination to seek in state tuition to North Carolina public schools and to establish eligibility for in state financial aid.
Residency Determination Service streamlines the process to determine residency through a standardized online interview process accessible from campus admission applications, CFNC, and directly on the RDS website.

Members of the Armed Forces and Their Families
Active duty personnel in the armed services, and their spouses, dependent children and dependent relatives may be eligible for in-state tuition. An active duty member of the military (and their eligible family members) who qualifies for admission to an institution of higher education in the State may qualify for in-state tuition in two ways:
as a domiciliary of the State or
under a special provision of North Carolina and federal law requiring that non-resident active duty military personnel and their eligible family members be charged in-state tuition

The North Carolina general statute (specifically GS ) for active military receiving the in-state tuition rate under the Permanent Duty Station does provide for “continuous enrollment” under certain circumstances.

NOTE: individuals using this benefit are not eligible under the statutory grace period provision since they have not been classified as a resident of NC, but only allowed to pay the resident tuition rate.
An individual’s eligibility to receive these military-related tuition benefits continues only so long as the requirements continue to be met.

Reassignment Out of NC:  Service member and his or her spouse and dependent relatives will continue to be eligible for the in-state tuition rate as long as:
service member, spouse, or dependent is “continuously enrolled” in the degree or other program in which they were enrolled at the time of reassignment.  This means the covered individuals must be enrolled in consecutive semesters (not including summer).

Retirement: Upon retirement the covered individual will continue to be eligible for the in-state tuition rate as long as they remain continuously enrolled in the degree or other program in which they were enrolled at the time of retirement.  This means the covered individuals must be enrolled in consecutive semesters (not including summer)

Honorable Discharge: Active duty member receiving an Honorable Discharge (no other type of discharge will qualify), the service member is eligible for:
in-state tuition rate if he or she establishes legal residency in North Carolina within thirty days of discharge and is continuously enrolled in the degree or other program in which they were enrolled at the time of discharge.

covered individuals must be enrolled in consecutive semesters (not including summer)

RDS Reconsideration is for students who:
Need to correct certain errors in the data submitted during the RDS online interview
Have had a change in personal circumstances since completing their current determination
Did not submit the required documentation within the initial consideration timelines
Are requested by campus to complete a new determination

RDS Appeal – Level 1
RDS Appeal process is for students who have the ability or need to provide additional information and documentation to their claim of residency.
Students have ten calendar days from date of the determination they are appealing, or status change due to failed validation, to submit Notification of Appeal
Some students depending on the status of their appeal process will have the ability for a face-to-face appeal hearing with RDS

25. SEAA Appeal – Level 2 RDS Online Interview – Student Experience
The SEAA Appeal Level 2 process is available to students who remain non-resident following an RDS Appeal.
Students will not submit additional information or documentation to support their appeal, similar to the SRC process today.
The SEAA Statewide Appeal Committee will review student cases to ensure the process is conducted fairly and correctly, and the outcome is correct based on information provided in process.
Committee members will be comprised of practitioners from NCICU, NCCCS, and UNC and administered by SEAA.
