E-FILING: THE IOWA EXPERIENCE
Perspectives on the Electronic Document Management System (EDMS) for Iowa Courts David K. Boyd State Court Administrator

Iowa: Field of Dreams Statewide unified trial court.
State funded court system. All judicial officers and support staff, including clerks of court, are employees of the judicial branch. IT a function of the state court administrator’s office . Single case management system (CMS) already in place—Iowa Court Information System (ICIS). Statewide e-filing system now in place—EDMS. E-filing now mandatory for all case types, all filers.

Business Problems Summary
Judges cannot get case files quickly Only one individual can have a case file at any time Judges cannot find specific text in filed documents Time lost in locating, pulling and re-filing case files Court staff spends inordinate amounts on data entry Not enough room in the courthouses to store paper files Case files can be lost, defaced, or stolen by the public. Documents get lost while being passed from clerk to clerk. Attorneys cannot get timely access to court materials Files destroyed – by fire, flood, or other disasters – there is no replacement

For years, the courts have struggled with these business problems: File storage limitations File access—limited to one person at a time Files not up to date Judges need files when not in county Rural access to justice Mail as slow way to deliver urgent documents File security—integrity of documents Remote storage caused delays

Eliminate file cabinet storage and future off-site storage Facilitate court response without physical file Reduce delays resulting from papers not in files Multiple court personnel and user access to court docs Available from any internet access point Timely delivery of court rulings Kiosks onsite/offsite for public/users access

Reduce attorney contact with judges Increase/decrease work for attorneys Increase/decrease work for any users SUMMARY: No intention to impact the net work effort of non-court personnel

EDMS: The Importance of Governance
Rules Committee was appointed by Supreme Court Developed chapter 16 of Iowa Court Rules for technological design and implementation of EDMS After Rules were approved, a core group of that committee became Business Advisory Committee (BAC)

Governance: Business Advisory Committee
Business Advisory Committee (BAC) was appointed by State Court Administrator Core group from Rules Committee, plus additional representatives throughout EDMS implementation Address business problems, users questions, rules amendments, program enhancements Provides the nut and bolts, day-to-day business direction for technology implementation Phone conference calls scheduled every week since before pilot counties, periodic all-day in person meetings

Business Advisory Committee
Committee makeup: 2 Clerks of Court 1 District Court Administrator 2 Chief Judges 2 District Judges 1 Appeals Court Judge 1 County Attorney 2 Private Attorneys 1 Senior Judge The Clerk of the Supreme Court Other business & technical advisors One change since we met last year. Chief Judge Charles Smith from the 4th Judicial District retired. Darin Raymond, County Attorney for Plymouth County was named as a replacement.

Implementation Strategy
Install by Judicial sub-district Outreach to legal community Training for judges, lawyers and other users must be provided Ongoing support for judges, lawyers and other users Implementation schedule must be realistic, regardless of how long it takes Training may take the form of in person / online web based / and some ‘hand-holding’. We will be evaluating each method and working to find the most effective and efficient methods. Recently in an e-Courts conference one group of trainers stated that adult attention span in training used to be 20 minutes, but experts are now saying this attention span is reduced to 3 – 10 minutes.

Attorneys/parties access to court files Access to filing documents 24/7 Reduce time and expense of filing documents Near real time notification of docs filed Resistance from judges and lawyers Difficulties for self-represented litigants Capture data for re-use without re-input Increase work at some stages, offset by decrease at other stages

Case initiation—data input of confidential info and civil case cover sheets increased time for case initiation Filing documents—no printing, mailing, hand delivery of court docs Business processes would change—for courts, lawyers and other frequent filers Vendors for users would develop technology solutions/enhancements

Problems with case management system development for prosecutors Case initiation takes longer for criminal cases Resistance to some users changing internal business processes Reduced Judge-Attorney interaction Increase in law enforcement complaint filings No immediate need for kiosks

Iowa EDMS: What’s next? Continued development and enhancement of EDMS
Assure stability of current EDMS system Refine redundant systems for reasonable assurance of access Enhance existing disaster plans Identify and develop processes for greater automation and efficiencies
