CITY OF ATLANTA MAYOR’S OFFICE OF CONTRACT COMPLIANCE OCC Roles and Responsibilities Certification Participate in project pre-planning meetings with DOP & User agencies Analyze scope, schedule, budget, & funding source information to craft availability goals for “Appendix A” documents Participate in Project Pre-bid meetings Respond to diversity related questions during the bid process and evaluate bidder responsiveness to Appendix A requirements Monitor diversity performance for the life of projects including all amendments and change orders Site visits and audits Performance metric reports federal reports Contractor dispute and payment dispute resolution To reinforce and support outreach efforts that open contracting opportunities to all businesses regardless of race, gender, or ethnicity.

Mayor’s Office of Contract Compliance Introduction The Current EBO Ordinance began January 1, 2016. In order to have a legally defensible program, the City of Atlanta must demonstrate that the program is narrowly tailored to remedy the present effects of past discrimination. In the most recent disparity study, the team led by Keen Independent Research LLC determined that there were significant statistical disparities in the use of Minority- and Female-owned businesses seeking opportunities in Atlanta.

Mayor’s Office of Contract Compliance The EBO/SBO Ordinance Categories of contracting contemplated during the study are as follows: Construction – e.g., excavating, building; Professional Services – e.g., design, architecture, consulting, environmental work; Other Services – e.g., catering, security, limo services, cleaning; Goods – e.g., commodities, pens, paper, toiletries. OCC’s list availability in each bid solicitation document by category Construction: MBE (AABE/APABE/HABE) % FBE % Professional Services: MBE (AABE/APABE/HABE) % FBE % Other services: MBE (AABE/APABE/HABE) % FBE % Specific Goals are defined on a contract-by-contract basis.

Mayor’s Office of Contract Compliance The EBO/SBO Ordinance cont. SBO Program Participation Availability: Engages Small Business Enterprises (up to 35%) on SBO identified projects. SBO Program Certifications: The City of Atlanta certifies SBEs using criteria set forth within the Ordinance. Reciprocity: The City will allow Disadvantaged Business Enterprises (“DBEs”), SBA 8a firms, and SBA Hubzone firms from the federal program to have reciprocal SBE status in the City of Atlanta’s SBO Program. SBO Sheltered Market – No Change: Select eligible projects will be set aside for competition between SBEs if there are enough SBE vendors to allow competition. Ten Year Graduation Requirement: Upon 10 years of continuous participation in COA’s diversity programs, OCC will review 3 year average gross receipts to see if a firm exceeds SBA size standards.

Mayor’s Office of Contract Compliance Title VI In compliance with Title VI of the Civil Rights Act of 1964, the City of Atlanta assures that no person shall be excluded from participation in, be denied benefits of, or be otherwise subjected to discrimination under any program which is federally funded. The Mayor’s Office of Contract Compliance is responsible for implementing and monitoring Title VI activities as required by federal regulations.

Mayor’s Office of Contract Compliance Title VI The Office of Contract Compliance is responsible for the following related to overseeing Title VI Program Administration -Ensure compliance with policies and procedures. Complaints -Ensure effort is made to resolve any discrimination complaints. Data Collection -Gather any statistical data respective to race, color, sex, etc. Environmental Impact Statements -Review Environmental Impact Statements or Assessments. Training Programs -Conduct training on Title VI issues.
