DISTINCTIONS BETWEEN CIVIL AND CRIMINAL CASES
The cases take place in different courts The person starting the case is given a different name The terminology used is different The standard of proof is different

In a criminal case the defendant is prosecuted on behalf of the Queen therefore cases are written:

In a civil case a claimant brings a claim against another individual or organisation. Therefore, cases are written: Brown v Smith (2003) How to write out a case
