PRINCIPLES OF ISLAMIC JURISPRUDENCE (ELM USOOL ALFIQH)
Shaheed Ayatollah M.B. SADR.
2
Lesson one: Foreword The Howza curriculum for Usool Alfiqh for about last 50 years (from the work of Sh. Alsadr) was as follows: Maalim- Sh. Thani Qawaneen/Usool Mozafar Rasaael- Sh. Alansari Kifaya- AlAakhud

Disadvantages of the previous books
1-Time factor: Since these books were written until now it has been about century, and lot of theories have been improved, and old one has been rejected, besides that there has been a lot which has been added until now, which the students might benefit, especially the greats scholars work who came after the authors of previous books. There a huge experience which has been added to their work, new laws and principles. So if the student studies the old theories and then enters the external researches, he experiences a great skip.
4
2-These books were not written for the purpose of teaching:
These for notes of the scholars and record for their ideas and opinions, so it lacks the gradual educational sequence from book to book, it lacks the educational integrity which is step by step. There are some points in a book which require pre requisite information, and that does not exist. It lacks the academic form from simplicity towards difficulty.
5
3-Unnecessary prolonged researches
There are lengthy and detailed in depth researches in Rasaael, which a student does not require to study them at that level, and requires other topics to be studied instead, and such researches require some prerequisite topics which may ease the understanding of such detailed and lengthy researches.
6
4-Repetition and overlapping
Since these books were written by different noble great scholars and not for the purpose of teaching, so it is observed that there is an overlap and repetition of some topics.
7
Usool Mozaffar This is one of the greatest attempts to write an book in this field, which is written for academic purpose, with the intention of teaching, but still with all the efforts of the great scholar Sh. Mozaffar, it can be considered a link between the first book, and the 3rd book, and not a complete replacement for the four books, or even consider it to be a link in between and that is because:
8
1-Different Style The three old book has old opinions and old style, and then in between the Usool of Mozaffar is considered a very modern and recent approach, which has modern theories both in Usool and the modern educational method. And after that the student will be taken back in time to study the old theories and old books.
9
2-Differece in division of the book
The books were divided into section in a different method form the book of Sh. Mozaffar, some topics were under different title, and in recent book they might be under different title, which might create confusion for the stidents.
10
3- Inadequacy in the quality and the quantity of the researches
Some researches are discussed very shortly and briefly, and others are discussed in length and in depth which takes the book out of its purpose as being a link, and as an academic approach. In some researches the author goes even more deep than the Kifiya.
11
The entire replacement
Sh. M.B. Sadr wrote a whole method in a very unique academic style and sequence, adequate in the quality and the quantity of each level, step by step, until the student is graduated to external research level. He mentions these 10 points taken into consideration while writing this book:
12
1- The purpose To teach the student academically from the zero level to the external researches (Bahth Kharij), step by step and level by level. From the simplicity to the depth. To tech them the recent theories and opinions in this field.
13
2-A complete curriculum in sequence
The researches are integrated from one level to another, interlinked, and the student must study one after another in order to understand the upper levels. So the 1st level is required in order to understand the second and so on.
14
3-Researches which are supposed to be of external researches are avoided
4-The primary division or the classification of the topics are almost same as in the previous books. But modifications have been made in the classification of Sub divisions. 5-Begins from simplicity and ends with the complicated researches. 6-The levels depending on the students ability to understand.
15
7-Lengthy and deep discussion are kept in the third level.
8- Avoid repetition in the researches in every level 9- Clear words away from ambiguity and vagueness. 10- The conclusions are not necessarily our opinions.
