4 2015-16 Title IX Sexual Assault Prevention Strategy Roadmap

5 What Have We Learned from Other Campuses? “Occidental College”
Schools with current investigations: Amherst College, Duke, University of Northern Colorado, Notre Dame, Yale, University of North Carolina, University of Connecticut, Xavier, Swarthmore, USC, Montana, Dartmouth, Vanderbilt Two local campuses where we have learned lessons from are: Occidental and UC Berkeley LOS ANGELES — Festering complaints that Occidental College’s administration has retaliated against those who speak up about sexual violence have broken open with new revelations of how faculty and students were allegedly treated after they reported sexual assaults or supported those who did. More public statements that have been made by the Chancellor and a new survivor resource page that was developed.  Here’s more: The Chancellor has issued a statement.  In the letter, he lists some changes/additions to the current system, such as hiring another staff member in our Title IX Office (Office for the Prevention of Harassment and Discrimination), funding a Survivor Advocate Position, etc.  You can read it here:   The Survivor Support page can be found here:   And of course the big things are making sure that policies are up-to-date with regard to VAWA and Camus SAve Act.  The UC system just put into place a revised policy to include the new provisions.  You can view it herehttp://policy.ucop.edu/doc/ /SHSV 6 April 27, 2016 Saint Mary’s College “Confidential”

9 What Are We Doing Well? We have strong Title IX policies and procedures in place. Faculty and Staff Guide: Assisting Students in Distress (Red Folder) – includes a Title IX Section. Title IX Coordinator, Deputy Coordinators, HR and Student Life investigators receive annual investigations training. Engaged Vice Provost Undergraduate Academics on strategies to orient new freshman and transfer students. College-wide communication processes have been comprehensive, consistent and thorough - annual mass sent to staff and faculty and campus bulletin announcement. 10 What Has Happened Since Last Year?
Title IX Committee structure has been strengthened by adding a faculty member and student leader. Rise of the Investigator Model for student cases. Launch of a Sexual Assault Campus Climate Survey – April, 2016. Launch (LawRoom) Sexual Harassment on-line training – April, 2016. Introduced the “It’s On Us” Bystander Intervention Program through SMCares campaign. Trained Student Organization Leaders at Fall Summit. Hired a new Director of Sexual Assault Prevention to replace the Coordinator of Sexual Assault Awareness, Outreach, and Education. 11 What Are The Potential Gaps/ Risks?
Strategies to reach students beyond Week of Welcome and Orientations. Need additional resources to handle Title IX Sexual Assault investigations (complexity, volume, time). Funding needed for all Title IX initiatives (training, records management software, outside investigation consulting, collateral, brochures, posters, etc). Extend CARE line service to include new summer session. From a “Risk Management” perspective, we need comprehensive software tools and records management systems. Articulate a process for responding to an OCR Complaint or Audit. Evette and Eduardo Risk Management - We are working on identifying a software solution that will help us track and document sexual assault cases. And we are heavily investing in an HR Records Management system to specifically identify Title IX Sexual Assault Cases. OCR Complaint or Audit An OCR investigation is not a matter of “if it ever happens, it is more a matter of when.” Recent Case Study…..University of San Diego (USD) had to produce a list of EVERY formal and informal student complaint of sexual harassment, description of incident, process taken, hearings, results, appeals, remediation, investigation….with supporting documentation for the “LAST THREE YEARS.” Will involve Title IX Coordinator and Chief HR Officer, General Counsel, Dean of Students, Chief of Public Safety and others for weeks to compile data and prepare a response. Will need to involve AVP Communications. Need to invest in a centralized tracking system for all Title IX complaints. Inform “Board of Trustees” of our Title IX Sexual Assault Prevention strategy. Explore additional funding for training, resources, approve funding resources for a Chief Diversity and Equity Officer (this is what to expect when OCR investigates?) Strategize how to address gaps so we can all be better prepared should we receive a notice of investigation. 11 April 27, 2016 Saint Mary’s College “Confidential”

15 What Can Faculty and the Academic Senate Do To Help?
Continue to influence faculty to complete the on-line sexual harassment training and other related training opportunities. Encourage faculty, staff and students to report any incidents to the Dean of Students or to my office as specified. Refer to your “Red Folder” in the event you need to refer students to the appropriate resource. (Contact Dean of Students for additional copies) Become familiar with our Title IX Sexual Assault Prevention Guidelines and our “Policy Prohibiting Discrimination, Harassment (including Sexual) and Retaliation in the faculty handbook (section pg. 112) Eduardo Next steps Continue briefing / training students, staff, and faculty throughout year.
