1 Notice of Proposal or Refusal to Take Action Form
This is a form changed in February and used to be called Notice of Intent Regarding Special Education Services. Although some of the uses of this form are the same there are additional times when it must be used. It is critical that this form is used in the following situations EVERYTIME. Use this form in Situations of NOT: These will be illustrated in the slides following. . There are many more scenarios when you could use this form But these listed below are the most common “NOTS”

2 . A student is not accepted for evaluation

3 A student is not eligible for Special Ed. Services

4 . A student is no longer eligible for Special Ed services

5 . A parent is not in attendance of a meeting

6 . A parent is not in attendance of a meeting

7 . When a requested special education/related services will not be provided

There are many other uses for this form that are not “NOTS”. Following are some scenarios where you must use this form. . You must use this form for Every Out-of-State transfer stating you are providing comparable services will in the eligibility process. . This form should be added to the Referral Process as soon as the folder is created. . At the same time a Person’s Responsible Form for the Out-of-State IEP should also be filled out in SETS and signed by appropriate teachers. . Do not type in out-of-state IEP.

If you want to select all things on the previous eligibility form hit the check box by Area. If not, just check the areas you want on the new form. Hit COPY button

21 The form will not close if all the areas with the asterisks are not entered. Again more is better, If it is referral and several exceptionalities make sure all required areas are entered. For re-evaluations, check the reevaluation box and select the disability area, save the form before accessing the Areas of Assessment, a list of areas will display on the screen. As the areas are entered on the form the list will get smaller. This list is another visual cue to assist with Compliance for the disability selected. You are not limited to the Areas displayed. More may be added. The items with asterisks must be included for closure. At least one of the items without an asterisks must be added for closure.

After clicking on the blue line on the eligibility form and viewing the screen we looked at previously you hit INSERT. This screen comes up. Select AREA

Select the category you want to enter

Find the assessment you want. Select it.

This is how it will look. Continue to add assessments. Again more is better.

The following is the way the form is filled out for the first meeting of the initial referral Note** For children under 15 the first 5 people are ALWAYS invited

X Review and Revise IEP is used when you are amending or having a meeting with the parent to review the IEP. Conduct Manifestation Determination is used when a manifestation hearing is taking place. Develop Functional Behavioral Assessment Plan is used when the IEP team meet to develop an FBA. Develop/Revise Behavioral Intervention Plan is used when the IEP team want to meet to either develop or revise a behavior plan. Conduct a Resolution Session is used when a resolution meeting is being held..

32 How To Correctly Fill Out the Bottom of the Notice and Invitation to a Meeting
If the parent does not respond but comes to the meeting, make sure you go back and have them sign the invitation. Fill it into sets as well.
