2 IMOLA (Interoperability MOdel for LAnd Registers)
PROBLEM: Increasing number of cross border transactions and cross border litigations The need to for a standard means of accessing basic land registry information within the EU The ”translation” issue (not only grammatical translation, but also translation of the legal concept) SOLUTION: IMOLA (Interoperability MOdel for LAnd Registers) Project managed by ELRA With support, in the form of a grant, from the European Commission (Civil Justice Programme) 2

6 FRAMEWORK FOR ELRA TEMPLATE
Judiciary Cooperation ELRD may be a tool for requirements of LR information in the scope of Regulations (UE) on Successions, Recognition of judiciary resolutions and Insolvency; also for framework decisions in criminal matters Cross border conveyancing Exchange of information for contracts of sales and mortgages Interconnection of Land Registers A scheme for the information from a legal point of view 6

all properties or entities having an individual identification in national land registry system: Property Apartment/flat Cadastral parcel/plot Property rights In deed systems connecting factor may not be the property, due to the totally different way to organize the information. In these cases the L.R. UNIT should be consider the owner of the property right Choice of L.R. UNIT will be decide by national land registry, according to local criteria Minimum denominator should be: LR UNIT INDENTIFIER LR UNIT LOCATION Different levels of description 7

14 IMOLA TECHNICAL SCOPE Define a semantic model for standardized land registry output Develop a template for ELRD using XML standards (XML scheme and XSL) Unify acces to national LR, disclosure through e-justice portal National LR systems are respected Compatible with e-codex platform and aligned with ISA standards Explanatory material linked to the template, including thesaurus to improve understanding and compare legal systems 14
