OVERSIGHT IN THE APPLICATION OF LAWS REGULATING THE AREA OF EXPLOSIVE MATERIALS AND PYROTECHNICS Area of trade in explosive materials is regulated by the Law on Explosive Materials(“Official Gazette” of Montenegro no. 49/08 ), which accurately stipulates the conditions for production, trade, procurement, storage and use of those materials. Conditions under which the explosive materials are transported and activities related to this transportation (preparing materials for transportation, loading, offloading and accompanying manipulation) are regulated by the Law on Transport of Dangerous Materials (“Official Gazette” of Montenegro no. 5/08 ). The area of transport of armament, military equipment and dual purpose goods is regulated by the Law on Foreign Trade in Armament, Military Equipment and Dual Purpose Goods (“Official Gazette” of Montenegro no. 80/08). PROCEDURES Section for Preemptive Activities and Inspection Oversight has devised a methodology-procedure for issuing approval for procurement and transport of explosive materials. Regional branches, upon reception of a request for procurement or transport of explosive materials, and with necessary check-ups carried out, submit, on a common form, all necessary information on the party submitting the request, with types and quantities of explosive materials and the place of procurement and the direction of movement of the transport vehicles. Data is immediately fed into the database ad the regional branch sends a written notification, after which the approval is issued for the procurement or transport of the explosive material. The results of such a procedure are as follows: Trade and transport of explosive materials is actively monitored from multiple levels, executive and control and oversight; All information converges in one place, therefore it is possible to always obtain accurate information on the trade and transport of explosive materials for entire Montenegro. For the territory of Montenegro, a database has been created on trade and transport of explosive materials, with all the necessary data. It cannot happen that explosive materials reach their destination before the arrival of a transport telegram; Trade and transport of explosive materials can be immediately harmmonised with the current security situation in Montenegro, if need be; M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 1: Free Movement of Goods

EU DIRECTIVES REFERRING TO CIVILIAN USE EXPLOSIVES AND PYROTECHNICS Directives: Civilian use explosives, directive 93/15/EEC, Pyrotechnics, directive 2007/23/EC Directive 2007/23/EC has not been implemented in the new Law on Explosive Materials The Law on Explosive Materials is partially harmonised with the directive 93/15/EEC.
