Getting it right: Understanding How to Legally Use Music & Technology
Abi Enockson (MorningStar Music), Michael Moore (Augsburg fortress), and Jim Rindelaub (alcm)
2
Why are copyrights so important?
A copyright is used to protect original works of authorship. We want to you to use the music, but we also want to protect the integrity of the original work and the composer/author who created it.
3
Church performance Churches granted broad performance license for use in context of worship service. Be aware of the limitations of this license: Live performances only! No filming or recording is allowed. No charging admission! Free-will offering is fine. Video is specifically exempt. i.e. No use of videos in your worship service without permission.
4
Congregational reprints
When a church bulletin is printed, the church becomes the publisher of all content of the bulletin. Anything in the church bulletin under copyright to someone must have permission BEFORE use. Includes: - Texts - Tunes - Arrangements - Translations **May require multiple permissions if there are different publishers. Only worry about elements that are to be printed.
5
Congregational reprints: using licensing agencies
One License - Traditional focus and includes more famous acoustic church artists as well. - Primarily functions as a reporting service, secondarily as a downloading service. - Requires 100% of usage to be reported weekly or monthly. CCLI - Best fit for churches with contemporary, band-led focus. - Requires reporting every 2.5 years, for a six-month period. Averages use and pays royalties based on that. Not a member of either? Will require permission directly from publisher.
6
Congregational reprints: licensing agencies & being legal
To be legal, you MUST report usage. Not enough to just have a license. Recognize which publishers are covered by which licensing agency. One License or CCLI must be included in the bulletin.
7
Streaming & podcasting
What’s the difference? Streaming is live. Podcasts are stored or hosted on a website, allowing listeners to listen multiple times after the event. One License and/or CCLI license can help you sort out these requirements.
8
YouTube Be careful. Many publishers have made licensing agreements with YouTube which allows them to receive royalties for video content. Don’t be surprised if ads are attached or video is blocked altogether.
9
Sharing sound samples with choir
Check publisher websites for sound samples & share link to recording. If no recording exists, just ask.
10
Ipads & music scanning Scanning from a score is… okay?
More publishers are selling downloadable scores. Most require minimum number of copies be purchases for choral scores. Prelude Planner
