5 Duties & Responsibilities
Occupational Health and Safety Act Worker Duties Section 28(1) A worker shall: Use protective equipment required by employer Report to employer/supervisor: defective equipment or protective device; contravention of the Act/Regulations; existence of any hazard. Section 28(2) No worker shall: Remove or make ineffective any protective device Work in a manner that may endanger themselves or another worker

8 Health and Safety Concern Reporting
Health and Safety Procedure HS 02-01 Internal Responsibility System joint effort of management & employees to resolve safety concerns. Employee responsible to address concerns to their immediate supervisor (Principal, Vice Principal, Manager, Supervisor). Principal/Supervisor responsibility to review and endeavour to resolve the concern.

9 Health and Safety Concern Reporting
Classified as: Urgent / Life Threatening (i.e. Gas, Chemical, Fire) Employee notify Principal/Manager and occupants in area; assist with securing area Principal/Manager shall ensure safety of occupants and initiate remedial action Non-Life Threatening (i.e. General indoor air quality, Housekeeping, Ergonomics, Lighting) completes section 1 of the Health and Safety Concern Reporting Form notifies Principal/Manager investigation with employee may involve other resources (Facility Services, Special Education, Health & Safety) Employee may: Contact Joint Health and Safety Committee (JHSC) representative for advice

12 Worker Rights The Occupational Health and Safety Act provides three basic rights for workers: The Right to Know The Right to Participate The Right Refuse

13 Right to Know Workers have the right to know:
Actual or potential hazards in the workplace. How to protect themselves. Awareness - important step in reducing workplace injuries If you see a hazard report it

14 Right to Participate Workers have the right to Participate by:
Becoming a Joint Health and Safety Committee member. Assisting in solving health and safety concerns. Working safely and being a good role model. Reporting hazards. Providing feedback/input.

15 Right To Refuse Unsafe Work
A worker may refuse to work or do particular work where they have reason to believe they, or another person are likely to be endangered. Worker must immediately notify the supervisor: That the work is being refused. Explain the circumstances (Health & Safety) of the refusal. Two stages for investigating and resolving a work refusal: Stage 1 - Resolved internally by workplace parties Stage 2 - Not resolved internally. Ministry of Labour contacted to resolve. Refer to Health and Safety Procedure HS Health and Safety Work Refusals Reprisals by the employer are prohibited because a worker acted in compliance with the OHS Act.

16 Joint Health and Safety Committee
Required by Occupational Health and Safety Act Comprised of Worker & Management Members Role The committee is an advisory body that helps to raise awareness of health and safety issues in the workplace, recognizes and identifies workplace risks and develops recommendations for the employer to address these risks.** **the Ministry of Labour Guide for JHSC

17 Joint Health and Safety Committee
Functions Meetings (minimum quarterly) Conduct inspections Identify situations that may be a hazard Make recommendations Investigate critical injuries Participate in work refusals Present at beginning of any testing

18 First Aid and Medical Emergencies
If you have an injury Obtain first aid/medical attention Trained First Aiders at each site Know location of first aid kit If emergency medical services are required call Automatic External Defibrillators (AED) AEDs can be used in situations of sudden cardiac arrest. Learn where AEDs are located at your site. Public Access Defibrillators 911

19 Accident / Incident Reporting
Obtain First Aid / Medical Attention Notify Supervisor Complete Workplace Injury/Illness Report On staff website Refer to Administrative Procedure Memorandum (A4002) Supervisor follow up

20 Critical Injuries Reporting and investigation of “Critical Injuries” is a requirement under the Occupational Health and Safety Act (OHSA).  Critical Injuries are defined by the OHSA as: Places life in jeopardy or Produces unconsciousness or Results in substantial loss of blood or Involves the fracture of a leg or arm but not a finger or toe or Involves the amputation of a leg, arm, hand or foot but not a finger or toe or Consists of burns to a major portion of the body or Causes the loss of sight in an eye Refer to Health and Safety Procedure HS Injuries to Employees Critical and Fatal Administrative Procedure Memorandum A4002 & A5410

21 Critical Injury Process
Obtain emergency medical treatment. Ensure the scene of the incident is not interfered with, except: for the purpose of saving life, relieving human suffering or the prevention of unnecessary damage to equipment of other property, until permission is given by the Ministry of Labour. Notify Corporate Risk immediately Notify respective Superintendent. No official statement shall be released except under the authority of the office of the Director.
