5 Regulatory History Prior to OSHAct in late 1960’s
With rare exception states failed to meet their obligation 14,300 employees were killed annually and 2.2 million suffered a disabling injury Work related injuries were trending upward

6 Occupational Safety and Health Act
The Williams-Steiger Occupational Safety and Health Act of 1970 (84 Stat et seq., 29 U.S.C. 651 et seq.) requires, in part, that every employer covered under the Act furnish to his employees employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm to his employees.

7 Occupational Safety and Health Act (OSHAct)
The William Steiger Act took effect on April 28, The Occupational Safety and Health Administration (OSHA) came into existence as the OSHAct became law. Under Department of Labor

19 OSHA Inspection OSHA Inspection Procedure
An OSHA inspector will come unannounced to a location. They must present themselves to a representative of the organization (present DOL identification card) The Compliance Officer can go get a search warrant. May request a warrant Inspection procedures: Show credentials Opening conference Complete inspection tour Closing conference The employer must be advised by the compliance officer of the reason for the inspection and they must accompany the officer during the inspection. Inspector's Credentials An inspection begins when the OSHA compliance officer arrives at the establishment. He or she displays official credentials and asks to meet an appropriate employer representative. Employers should always insist upon seeing the compliance officer's credentials. An OSHA compliance officer carries U.S. Department of Labor credentials bearing his or her photograph and a serial number than can be verified by phoning the nearest OSHA office. Anyone who tries to collect a penalty at the time of inspection, or promotes the sale of a product or service at any time, is not an OSHA compliance officer. Posing as a compliance officer is a violation of law; suspected impostors should be promptly reported to local law enforcement agencies.

20 OSHA Inspection They will hold an opening conference with the representatives of the organization. They must tell the members the nature of the visit. (Random, target, employee complaint, etc.)

21 OSHA Inspection The route and duration of the inspection are determined by the compliance officer. An employer and employee representative may go with the inspector. Trade secrets confidential Employees are consulted during the inspection tour. CSHO will point out to the employer any unsafe or unhealthful working conditions observed (citations) Some apparent violations detected by the compliance officer can be corrected immediately

22 OSHA Inspection The inspector will review all hazards and corresponding violations identified during the inspection. May discuss control strategies and abatement period Employer is informed of appeal rights and consulting available through OSHA Consultation Programs

25 Goals of Policy 1. A primary goal of a workplace safety policy is to establish the expectation that it is the responsibility of all personnel to create and maintain a safe work environment.

26 Goals of Policy 2. The organization’s safety policy should also address the organization’s obligations under the Occupational Safety and Health Act to maintain a safe workplace.

27 Goals of Policy 3. The organization’s workplace safety policy should require employees to use universal precautions when applying first-aid or providing personal care to clients or each other. Exposure at the workplace to diseases that are transmitted by body-fluids, such as Hepatitis and AIDS, is regulated by OSHA.
