2 Idaho Overlegal Permit Process
Idaho Code Title 49 Chapter 10 Weight, Speed and Tire Regulations states: Permits for overweight or oversize loads -- Special pilot project routes and annual permits. (1) Upon application in writing to the board or other proper authorities in charge of, or having jurisdiction over a highway, the board or authorities may in their discretion issue a special permit to the owner or operator of any vehicle allowing vehicles or loads having a greater weight or size than permitted by law to be moved or carried over and on the highways and bridges.

3 Permit Information Overview
ITD issues 66,000 to 68,000 overlegal permits on a yearly basis. 45% - 50% of overlegal permits issued for non-reducible loads. ITD has a centralized overlegal permit office. Majority of overlegal permit requests are received via a phone call from customers. Requests for overlegal permits are seasonal. ITD Issues approximately 66,000 to 68,000 overlegal permits on a yearly basis. Approximately 45% - 50% of overlegal permits issued are for non-reducible loads. ITD has a centralized overlegal permit office comprised of 5 overlegal permit writers and 1 Vehicle Size and Weight Specialist. Majority of overlegal permit requests are received via a phone call from customers. Other requests are by mail, , fax and counter customers. Requests for overlegal permits are somewhat seasonal as Spring, Summer and Fall are the busy months.

4 Coordination District Maintenance Engineers determine logistical requirements needed to ensure safe movement and convenience to the traveling public: Routing for height/width/length or construction restrictions Number of pilot cars required Traffic Control Plan if required Permits that exceed certain weight limitations must be approved by ITD Bridge Engineer prior to issuance to ensure infrastructure is not damaged. Restrictions include lowered speed, center-lining of bridge, no other vehicles on bridge or denial of permit request. Permits that exceed certain size dimensions (exceeding 16 ft wide, or 16 ft high or 120 ft long) need additional approval prior to issuance from appropriate District Maintenance Engineers to ensure safety.

Your Economic Opportunity ITD supports the Trucking Advisory Council (TAC). While promoting commerce, ITD is diligent that safety to industry, traveling public and infrastructure is adhered to. ITD supports the Trucking Advisory Council (TAC). TAC advises the ITD Board on issues and policies concerning freight transportation, trucking safety and services in Idaho.  This includes laws, rules, regulations, policies and procedures affecting motor carrier operations within the State of Idaho.

6 Community Impacts Contested issuance of overlegal permits for Kearl Oil Sands Project . Imperial Oil contacted ITD in 2008 to determine what the requirements were to utilize US12 for the movement of their equipment. Imperial Oil conducted three public open houses in 2010. US12 is a scenic byway and an All American road. Additionally the Lochsa and Clearwater River are federally protected Wild & Scenic rivers. Prior to the movement of specialized equipment to the Kearl Oil Sands Project, there had never been a contested issuance of an overlegal permit. Imperial Oil contacted ITD in 2008 to determine what requirements they needed to meet in order to utilize US12 for the movement of their equipment. Imperial Oil conducted three public open houses in 2010 to inform the public of their plan to move the equipment safely and efficiently on US12. Attendance was approximately 350 citizens. The movement of this specialized equipment on US12 from Port of Lewiston to Montana border was contested as US12 is a scenic byway and an All American road. Additionally the Lochsa and Clearwater River are federally protected Wild & Scenic rivers.

Two hearings were held in December 2010 and April 2011. Due to delays, Imperial Oil reduced the size and weight of the modules in order to use alternate highways. Other moves still being made on US12 as they were not contested by Idaho citizens. Emmert International moved 4 coke drums to a refinery in Billings, MT. Two hearings were held (Dec 2010 and April 2011) and in each case, ITD was found to be following proper Idaho Code and Administrative Rules in the issuance of overlegal permits to all customers. Due to protracted delays in the permitting processes, Imperial Oil reduced the size and weight of the modules in order to use alternate highways in the movement of their specialized equipment. During the time that permits for Imperial Oil were being contested, there were moves still being made on US12 as they were not contested by Idaho citizens. Emmert International moved 4 coke drums to a refinery in Billings, MT.

Currently there are no Imperial Oil specialized equipment modules at the Idaho Port of Lewiston. Modules are being transported across Idaho on I-90 from the Washington to Montana on a consistent basis. No additional overlegal permit requests from Imperial Oil for the transportation of large equipment on US12. ITD continues to apply the same principles of safety, mobility and economic opportunity to the movement of all commerce on Idaho highways.
