Delete Chapter 34A - Medical Marijuana Cultivation Regulation Amend a section of the Zoning Ordinance (Chapter 24) Development Services overview approach: Topic-neutral review Focus on structure of the proposed Zoning Ordinance amendments Highlight the key changes This item is information only

3 Overview The Initiative would result in inconsistencies with the rest of the Zoning Ordinance There are inconsistencies within the language of the Initiative Many portions are State law incorporated by reference Difficult for the reader to follow as it is not self-contained If State law changes, this results in the change to local requirements Varying usage of the terms permit, license and business license Exceeds what a Zoning Ordinance can control Example – Labor Peace Agreement

Existing Chapter 34A Initiative Existing Chapter 34A - Up to 150 square feet Based on Parcel Size & up to 3 Recommendations 50 square feet/recommendation 0.5 to 5 ac – 50 square feet 5 to 10 – 100 square feet 10+ acres – 150 square feet Personal – up to 500 square feet 1 Person – 100 square feet Up to 5 recommendations – 500 square feet

Existing Chapter 34A Initiative Not allowed Commercial – 25% of parcel size Subject to State license thresholds No additional local limit

6 Key Issue – Commercial Uses
Existing Initiative Chapter 34A does not allow Commercial uses Zoning Ordinance (Ch. 24) does not allow Dispensaries Includes Commercial Cannabis Activity as the range of activities from cultivation to sale Requires a County Business License (Note: the County does not currently have a Business License program)
