Guardianship Guardianship is a legal proceeding in which someone (usually a family member) asks the court to find that a person is unable to manage his or her affairs effectively because of a disability. A guardian steps in the shoes of the person with a disability and makes the decisions for them. Different types of guardianship are available based on the specific needs of the individual: Guardian of the Person / Guardian of the Property Families typically begin this process to obtain guardianship a 3-6 months prior to the child turning 18. *If the student has a case manager, the family may want to talk with them as there is sometimes assistance available to cover the cost of obtaining guardianship. The family may also want to consider developing a special needs trust in order to protect the students benefits.
