Changes for CDM 2015 Process started in 2011 after review of 2007 performance 10 week consultation with industry in May/June Alignment with TMCSD – Notification threshold and domestic clients (redrafted to clarify) Removal of CDMC and replace with Principal Designers Removal of specific criteria for and reference to competence (SKE) Notification thresholds altered Enforcement through Clients arrangements (duty to ensure) Changes to application of Principal Contractor

Things to be Mindful of Competence is embedded in HASAWA, Management of Health and Safety at Work Regulations 1999 and throughout all key legislation The “spirit” of CDM hasn’t changed Multiple duty holders are allowed – no change Draft HSE industry guidance proposals complete and available on

“Construction Work” on “Construction Site” Duties of Principal Designer and Principal Contractor apply on projects where design work is carried out and there is more than one contractor

Construction Work De-commissioning Commissioning Demolition
Dismantling Assembly of pre-fabricated elements Disassembly of pre-fabricated elements Removal of a structure and waste produced Installation, commissioning, maintenance, repair or removal of mechanical, electrical, gas, compressed air, hydraulic, telecommunications, computer or similar services which are normally fixed within or to a structure

Construction Site “includes any place where construction work is being carried out or to which the workers have access, but does not include a workplace within the site which is set aside for purposes other than construction work;”

Client Duties A client must make suitable arrangements for managing a project, including the allocation of sufficient time and other resources: So that: the construction work can be carried out, without risks to the health or safety of any person affected by the project; and the facilities required by Schedule 2 are provided in respect of any person carrying out construction work. A client must ensure that these arrangements are maintained and reviewed throughout the project.

Client Duties A client must provide pre-construction information as soon as is practicable to every designer and contractor appointed, or being considered for appointment, to the project. A client must ensure that— (a) before the construction phase begins, a construction phase plan is drawn up by the contractor if there is only one contractor, or by the principal contractor; and (b) the principal designer prepares a health and safety file for the project, A client must take reasonable steps to ensure that— the principal designer complies with any other principal designer duties in relation to the project

Client Duties the principal contractor complies with any other principal contractor duties Where there is more than one client in relation to a project— one or more of the clients may agree in writing to be treated for the purposes of these Regulations as the only client or clients; and

Transitional Arrangements Timescales
6th April 2015 – Came into force 6 month transitional arrangements CDMC – Project completes prior to 6th October Transition to PD – Project completes post 6th October Project design starts post 6th April – FULL 2015 Regulations apply

Notification 30 working days AND 20 or more operatives working simultaneously 500 person days Meaning a radical reduction of notified projects and HSE visibility of projects. Full duties apply without notification

CDMC - 2007 Advise and assist the client with their duties
Notify HSE (Client Duty) Co-ordinate health and safety aspects of design work and co-operate with others involved with the project (Principles of Prevention) Facilitate good communication between client, designers and contractors Liaise with principal contractor regarding ongoing design Identify, collect and pass on pre-construction information Prepare/update health and safety file

Definition of a Designer
“means any person (including a client, contractor or other person referred to in these Regulations) who in the course or furtherance of a business— (a) prepares or modifies a design; or (b) arranges for, or instructs, any person under their control to do so,”

HSE originally proposed to remove from Regulations (similar to Work at Height) Consultation response and CONIAC meeting in November disagreed HSE propose “Signpost” Guidance Focus on sector specific guidance Applied through Client arrangements No current ACoP. No evidence of one in the short term
