IMMIGRATION AND CUSTOMS ENFORCEMENT (ICE) Under Pres. Obama, ICE was directed to only detain people with violent criminal histories. That directive is no longer in place. ICE is now detaining people who: Committed a crime, or multiple crimes Arrived at the border without a visa prior to formally applying for asylum or refugee status Have an outstanding removal (deportation) order on record, either pending or past due, or Missed prior immigration hearing dates.

Sanctuary Status A sanctuary city generally directs police and other city employees and agencies NOT to cooperate with ICE UNLESS there is an outstanding criminal issue CT’s sanctuary areas as of 3/31/17: Bloomfield East Haven Fairfield County Hartford Hartford County New Haven New Haven County New London County Tolland County Willimantic Windham County

Know your Rights- Police
Avoid being arrested Avoid driving without a license or in an unregistered or uninsured car Currently, there is no known connection between the drive only license and ICE detention You aren’t required to give police any information other than your name Being arrested by the police is different than being detained by ICE. Many people are arrested or ticketed and released back to the community.

Your rights if ICE comes to your door:
You don’t have to answer the door UNLESS ICE has a warrant signed by the judge with the name of someone in the house Ask to see the warrant without opening the door, perhaps through a window or peephole If they do not have a warrant, you have the right to tell them they can’t come in. Sometimes a warrant only allows them to search some areas of your home ICE may come in anyway. ICE may detain people NOT listed on the warrant. ICE may search areas of the house NOT listed on the warrant. Know your Rights- ICE

Plan Ahead Have a copy of all important documents (i.e. passport and birth certificate) in a safe place, and inform someone you trust Ask to speak with your lawyer and make a phone call. Memorize the phone numbers of your lawyer or family member who is in the United States legally. Complete a standby guardianship form to ensure the safety of your children with someone you trust. This form can be found on ctlawhelp.org/immigration. All living parents with custody must sign along with the trusted guardian. You can go to local legal aid offices for help. You do not need to go to court unless there is an issue getting a signature from child’s other parent. Starts as soon as you are detained. Lasts until you can be reunited with your child or a year or less. You can end the guardianship any time. Locate an ICE detainee at

Going to Court Regardless of legal status, you have the right to:
File for divorce if you or your spouse lived in Connecticut for one year. Get a custody order or child support. For help collecting child support, call Support Enforcement Services at Get a court order to protect yourself from domestic violence. Fight employment discrimination. Appear in housing court. If you are going to court and you do not speak English, bring a translator. In CT, some people are being detained when they try to access the courts.

Resources for Documented and Undocumented Immigrants

Help with SSI paper work’ Case management, mental health’ Refugee Resettlement, Immigration Services, Employment Services, and English as a Second Language classes. CT Students for a DREAM; College Access Program Coordinator Stefan at (English speaking); Jose Diaz (Spanish-speaking) ; Services available for undocumented students.; or Hartford Public Library: The American Place; If you need help with the transfer for guardianships or information about the rights of detained parents, please schedule an appointment and bring your green card. Services available for both documented and undocumented clients. Call , TDD/Text Hartford Field Office, 450 Main Street, Hartford (appointments for CT residents are scheduled here). Hours: 7:30am to 3:00 p.m. Monday - Friday (with the exception of the 3rd Friday of each month when the office is closed to the public). Services available for both documented/undocumented clients. Connecticut Legal Services; ; Free Immigrant Legal Advice Hotline is staffed M-F 9-5; a message can be left anytime requesting help. Low-income immigrants living in Connecticut will receive free screening and advice regarding legal rights, information about how to protect yourself and your family if you are detained, and other assistance. Immigrants of higher income will receive referral to appropriate resources. Services available for both undocumented/documented clients.
