19 CFR Part 192 Refresher A Self-Propelled Vehicle includes any automobile, truck, tractor, bus, motorcycle, motor home, self-propelled agricultural machinery, self-propelled construction equipment, self-propelled special use equipment, and any other self-propelled vehicle used or designed for running on land but not on rail.

19 CFR Part 192 Refresher The term “Used” refers to any self-propelled vehicle to which the equitable or legal title has been transferred by a manufacturer, distributor, or dealer to an ultimate purchaser.

19 CFR Part 192 Refresher For those vehicles exported by vessel or aircraft, the required documentation and the vehicle must be presented to CBP at least 72 hours prior to export. “Export” means the departure of the vessel “Presented” means available for examination Clock is ticking…does not include Saturdays, Sundays, or Federal Holidays

Current Process at the Port of Jacksonville
Titles/bills of sale are submitted to CBP a minimum of 72 hours prior to the departure of the vessel Carriers, couriers, freight forwarders and other exporter representatives drop off title/bill of sale packets. Exporters and freight forwarders send title packets by UPS, Fedex, DHL, etc. CBP separates, examines the packets, stamps the titles and accompanying documents, and releases The original title/bill of sale and accompanying documents One copy of the title/bill of sale and accompanying documents

Some Issues… Due to the volume, titles/bills of sale are regularly not returned validated before the vessel departs. In an attempt to help carriers, the Port of Jacksonville has previously authorized the export of vehicles whose titles have been submitted in compliance with the 72 hour rule We recognize this is in conflict with 19 CFR Part 192

Problems… During the process of submitting the title/bill of sale packets to CBP and the sorting of packets by CBP, original titles have been misplaced. Some title/bill of sale packets submitted by parcel arrive with document issues, no return envelope/invoice, are sent to the wrong address, etc.

As a result…effective July 16, 2012
No vehicles will be loaded on a vessel and exported without first having its title/bill of sale validated Prior to the 72 hour cutoff, an will be sent to with a VIN list for the titles being submitted to CBP for validation. The will be titled with: Vessel name, voyage number, date of departure The VIN list will be in Excel format and will include in separate columns: Year, make, full VIN

Now for the Documents…effective July 16, 2012
CBP Jax will no longer accept parcel packages with titles/bills of sale for validation. If we receive one it will be mailed back without validation. If asked, CBP will not recommend a courier

Exporters or their designee will physically deliver the title/bill of sale packets to the CBP Blount Island Office a minimum of 72 hours prior to departure, to include One original title or notarized bill of sale and one original dock receipt On CBP copy of the title or notarized bill of sale and one copy of the dock receipt One Exporter copy of the title or notarized bill of sale and one copy of the dock receipt

While present at the CBP Blount Island Office, the exporter or designee will Perforate all titles/bills of sale and all copies Place the original packet and CBP copy packet in a designated location (shelf) Retain the Exporter’s copy packet as validation for the export of the vehicle Pick up any original packets released by CBP

CBP will retain the original title/bill of sale packet for three (3) days. Our goal is to release the originals by close of business on the third day The exporter does not need the original to export, their validated copy is all that is required at the Port of Jacksonville

How is this better? Exporters will leave with confirmation that their titles/bills of sale are validated, so their vehicles will load CBP will have more time to spend on enforcement (Spirit of the Law/Regs) Due to new office procedures at CBP, no lost titles/bills of sale

Enforcement Action CBP will still need to have vehicles redelivered
CBP will still place vehicles on hold for enforcement actions CBP will still reject titles/bills of sale, but before the vessel departs CBP will perform periodic audits on vessel paperwork as an added layer of enforcement
