Response to legislative proposals Iowa Code definitions: Child in need of assistance Child abuse Data review & outcome measures Introduction DEC The Drug Endangered Children (DEC) stakeholder workgroup was established in SF 2258 by the 86th General Assembly of the State of Iowa. The Governor’s Office of Drug Control Policy (ODCP) was tasked with convening the workgroup to meet up to two times during the 2016 legislative interim. The workgroup charge stems from a legislative proposal that was not adopted during the 2016 session (HF 2206/SF 2165). The DEC workgroup was directed to examine issues and develop policy recommendations related to the protection and safety of drug endangered children for purposes of child in need of assistance and child abuse proceedings. The workgroup was instructed to request relevant data and outcome measures related to drug endangered children, comprehensively review and analyze such information, and propose a statutory definition of a drug endangered child for purposes of child in need of assistance and child abuse proceedings. Recommendations from this formal process are included in the following report. This report satisfies the requirement to submit findings and recommendations to the General Assembly by December 15, 2016. The DEC Workgroup met twice during the 2016 legislative interim. The first meeting was held September 22, 2016 and the second was held November 17, Minutes from both meetings are attached in Appendix One.

3 Proposed Changes “Drug Endangered Child” "Drug endangered child" means: A child whose health, safety, or welfare is endangered or threatened as a result of any dangerous substance activity in the presence of the child as defined in Iowa Code sections 232.2(6)(o), 232.2(6)(p), (2)(a)(6), and (2)(a)(7).* Child in need of assistance: Additions to the definition of “dangerous substance” to include: Cocaine, its salts, isomers, salts of its isomers, or derivatives; Heroin, its salts, isomers, salts of its isomers, or derivatives; and Opiate, Opium, their salts, isomers, esters, ethers, or salts of its isomers, esters, or ethers, or derivatives. Child abuse: include unlawful using, possessing, manufacturing, cultivating, or distributing a dangerous substance as defined in Iowa Code section 232.2(6) and as modified above. Mandatory reporter: Require a health care provider involved in the delivery or care of an infant affected by any substance abuse, or withdrawal symptoms resulting from prenatal drug exposure or Fetal Alcohol Spectrum Disorder to notify the department of the occurrence of such condition of an infant Enact changes to the definition of "Drug Endangered Child". Enact changes to the Iowa Code Section232.2(6) "Child in need of assistance. Enact changes to the definition of "Child abuse" of "abuse" in Iowa Code Section (2)(a) Enact an amendment to Iowa Code section (mandatory reporter code for full compliance with federal Child Abuse Prevention and Treatment Act and the Comprehensive Addiction and Recovery Act). Crucial to provide input on prevention and specifically the role of ACEs/ trauma informed care and prevention – the strategic plan will be tied to the budget and funding for these programs.

11 EVERY STUDENT SUCCEEDS ACT (ESSA)
The Every Student Succeeds Act—the new federal K-12 law—puts states and districts in the driver’s seat when it comes to accountability, interventions for low-performing schools, and more. It also gives them new flexibility on federal money and testing. The Every Student Succeeds Act, signed on December 10, 2015, builds on progress and solidifies many of the education reforms championed for the last seven years.

13 ESSA Local school districts or consortium of local districts that receive $30,000 or more in SSAE program funds must use at least 20 percent of those funds to develop, implement, and evaluate comprehensive activities and programs that: Are coordinated with other schools and community-based services and programs; Foster safe, healthy, supportive, and drug-free environments that support student academic achievement; Promote the involvement of parents in the activity or program; May be conducted in partnership with an IHE, business, nonprofit organization, community-based organization, or other public or private entity with a demonstrated record of success in implementing activities authorized under section 4108; and May include a wide variety of program and activities. School Support and Academic Enrichment grants of more than $30,000 per district are required to spend 20% on programs that are community based and have a record of success
