3 Introduction South Africa as other countries in the global community has a high population of abnormal vehicles. This is a direct result of continuing development and need for constructions and improvement of various infrastructures in the country. Energy (i.e. power stations), Roads, Stadiums, Dams, high rise or skyscrapers buildings continue to rise in the country. Our coastal towns and cities are currently engaged in the renewable energy projects, wind turbines for erection of wind farms are currently being transported by roads mainly in Western & Eastern Cape. This necessitates transportation of abnormal loads on our various roads infrastructures.

4 Relevant Legislative Framework
Section 92 (2) of the National Road Traffic Act, 1996 (Act No. 93 of 1996) provides that the fees payable in respect of any application or request made, or document issued, or any other matter referred to in this Act, other than the fees which relates to the registration and licensing system of motor vehicles, shall be prescribed. Section 81(3) provides that an MEC shall determine the fees or charges payable for a vehicle or load that does not comply with this Act. Section 1 of the NRTA defines prescribed as meaning prescribe by regulation, this means that the Minister prescribes regulations and therefore the fees. Currently the provinces determines the fees and send them to the Minister for publication and thus prescribing them.
