Court Decision Protest filed in U.S. Court of Federal Claims (Nov. 16, 2017 Dept. of Justice defended FirstNet in Case Overview The court rejected Rivada protest on all accounts (March 17, 2017) The court agreed with all facets of the FirstNet procurement process The court agreed with FirstNet’s reasonable decision that Rivada carried significant risk Finding “Accordingly, the fact that the agency included only AT&T’s proposal in the competitive range does not demonstrate that the government applied an unstated preference for a large carrier; it merely reflects the agency’s reasonable determination that Rivada’s proposal carried too much risk” Decision Innovative Public Private Partnership (Goal of slide: review how partnership works - what FN brings, what partner brings – how we will work together) FirstNet and partner x will deploy a network solution that is tailored for public safety across the U.S. and territories as quickly as possible. This public-private partnership will leverage resources – such as infrastructure - and use private sector expertise and best practices to build and operate the network for public safety FirstNet will serve as an advocate for public safety and help drive innovation for first responders. We are bringing our PS expertise, as well as spectrum and start up funding to the partnership XXX is a proven technology partner and will focus on building and operating the nationwide network – something they have done before. Partner will provide FirstNet with funds for network reinvestment for ongoing improvements, focus on/dedicated to public safety, etc. The selection of the technology partner was based on the overall best value and solution for FirstNet and the public safety community. Cost was not the only factor; the award considered financial sustainability and assessed the offerors’ ability to submit a cost-effective and innovative model that could meet or exceed the 16 objectives and evaluation factors outlined in FirstNet’s RFP. In addition, FirstNet will advocate for public safety’s needs and hold the partner accountable to deliver services that public safety has asked for and expects.

And we must provide a network that evolves with technology, so public safety has at its fingertips the apps, devices and sheer strength of service it needs in life-threatening situations. There is no end to the possibilities for innovation in public safety once we have the bandwidth and connection we need to support that innovation.

State Plans Timeline Timetable to next big Milestone: STATE PLANS DELIVERY As you will see here, we are moving quickly to get to the State Plan governor decision BEFORE the STATE PLAN May 5: FirstNet released the State Plan Guidance Package June 7-8: FirstNet hosts an in-person meeting for all SPOCs and up to 4 additional attendees from each state or territory to review key information in the State Plan Portal, as well as to review the process around the State Plans. States and territories should be ready to submit the names of individuals who need full access to the State Plan Portal at this meeting. FirstNet recommends members of the Governors’ staff be part of the State Plan review. Additional users can be added after the portal is released. STATE PLAN DELIVERY & REVIEW June 19: FirstNet plans to release State Plans to all state and territories – to include the SPOCs and staff from Governor’s offices - via an online web portal. States and territories will have up to 45 days to review and comment on the plan. FirstNet will review all comments submitted by states and territories and make any necessary refinements it determines appropriate in conjunction with AT&T. We expect this to take up to 45 days. Upon completion of FirstNet’s comment review process, FirstNet will provide official notice to the Governor (as well as inform the SPOC) of each state or territory of the completion of the requirements under the law to advance to the Governor’s decision and begin the official 90 day review period required, including: The completion of the FirstNet RFP process; details of the proposed plan for buildout of the network in the state or territory via the State Plan; and NTIA funding levels for the state or territory as determined by NTIA. Governors will have up to 90 days, as set forth in FirstNet’s enabling legislation, to make their decisions regarding the State Plans. The State Plan Portal will include the letters to be leveraged by the Governor to indicate his/her desire to opt-in or opt-out. Once the Governor approves the State Plan, or the 90 day review period lapses without any action by the Governor, FirstNet will begin offering services to public safety entities in the state or territory. Among the key benefits that will be available to opt-in states or territories is that FirstNet will offer priority services on all AT&T LTE bands to public safety entities. FirstNet plans to offer preemption services by the end of the year. If the Governor does not indicate a decision within those 90 days, the state or territory will default to opt-in, and FirstNet will deploy the state or territory’s Radio Access Network (RAN). ACCELERATED OPTION for STATES THAT WANT TO MOVE QUICKLY Based on our interactions with states and territories, we’ve heard some states and territories express a desire to move more quickly with the Governor’s decision. As such, we’ve included an option to allow states and territories the highest level of flexibility within the process. Any time after the State Plans release via the State Plan Portal (expected June 19), if a state or territory indicates it would like to make its decision regarding the State Plan (i.e. opt in or opt out), FirstNet will officially notify the Governor (as well as inform the SPOC) of the completion of the requirements under the law to advance to the Governor’s decision, and begin the official 90 day review period required under law, including The completion of the FirstNet RFP process; details of the proposed plan for buildout of the network in the state or territory via the State Plan; and funding levels for the state or territory as determined by NTIA (assuming NTIA has made such funding level information available). Notifying the Governor of the completion of these requirements and the official delivery of the State Plan starts the 90 day decision period under FirstNet’s enabling legislation for each Governor to make his or her decision regarding the State Plans. We are delivering on our promise from the early days of FirstNet that the states will have the opportunity to review the State Plan before its official notice to the Governor We are confident that the solution that we will deliver to the states will provide the best coverage, capacity, and services at a compelling cost point Opt In: This is also a low-risk option that will support faster delivery of services to the state’s public safety community and help create an interoperable, highly secure, sustainable nationwide network for public safety. Opt out: States will assume all technical, operational and financial risks and responsibilities related to building their own RAN for the next 25 years. Either way – whether state opts in or out - FirstNet will work to ensure the State is successful with their decision Prepared under Contract No. D17PC FirstNet retains title to these materials. Public availability to be determined under 47 U.S.C. 1426(d).
