AUTOMATED COMMERCIAL ENVIRONMENT (ACE) UPDATE

In February 2014, the President signed an Executive Order mandating completion of the Single Window and use by all agencies with a role in trade processing by the end of 2016. ACE serves as the United States’ Single Window, or single system through which industry submits and government agencies process trade data. Trade will submit the data needed by all agencies once, and ACE will take that data, pull out the data required by each agency and push that data to the agency. Benefits are great for both Government and industry – less paper, faster decision making, greater risk assessment capabilities. CBP is working, in close coordination with our Partner Government Agencies (PGAs) to complete full implementation of the Single Window for international trade by the end of December 2016, in line with the President’s February 19, 2014 Executive Order. ACE will become that “single window.” BACKGROUND There are 47 agencies who play a role in the facilitation of cargo. Each agency has it’s own processes, forms and systems.

Here are the details of what we’ve deployed thus far. 100% of Import Manifest functionality is now in ACE. All electronic truck, ocean, rail and air manifests must already be filed in ACE. More than 95% of core Cargo Release processing capabilities have been delivered in ACE. We’ve expanded ACE Cargo Release for 01, 03, 06, 11, 23, and 52 at all ports for all modes of transport. Benefits of ACE Cargo Release include: Eliminate submitting paper Form 3461 (entry document) File shipment data prior to carrier notifying CBP of departure Receive status updates prior to cargo arrival No need to submit corrections through a paper form Make corrections to cargo entry data electronically File expedited release capabilities (FAST, Brass, Line Release) More than 80% of Post Release capabilities are in ACE. Entry types 01, 03, 06, 11, 23, 51 and 52 can be filed in ACE, representing almost 99% of entry summaries filed. Entry summary validations, identified as a top priority by brokers, have been significantly expanded in ACE. Benefits of ACE Entry Summary filing include: Eliminate submitting Form 7501 (paper entry summaries) Request ACE cargo entry certification from ACE entry summary File Antidumping/Countervailing Duty entry summaries (Entry Type 03) using Remote Location Filing (RLF) Process Census warning and overrides electronically through ACE Transmit Post Summary Corrections (PSC) electronically, receive refunds quicker Gain access to an expanded AD/CVD query Obtain more information from the ACE Entry Summary query 100% of export processing functionality has been deployed in ACE. The Automated Export System (AES) is now part of the ACE platform. Pending the issuance of a Federal Register Notice, a pilot will be initiated for electronic air, ocean and rail export manifest capabilities. Web filing for ACE AESDirect is now available, including Weblink filing for ACE AESDirect. More than 85% of Single Window integration capabilities have been deployed in ACE. We’ve delivered the core technical foundation for the Partner Government Agencies (PGAs), and are now focused on integrating PGAs in ACE. We are actively working with PGAs that have requirements at time of entry or entry summary to ensure readiness and meet the July 2016 deadline.

February 28, 2016: CBP began divesting the legacy Automated Commercial System (ACS). This transition shifted technical and customer support resources away from the legacy ACS system, a necessary step to focus critical resources in support of the new system, ACE. March 31, 2016: Filers required to file in ACE electronic entry summaries for the most commonly filed entry types, AND electronic entries and entry summaries with Animal and Plant Health Inspection Service (APHIS) Lacey Act and National Highway Traffic Safety Administration (NHTSA) data. The legacy system, the Automated Commercial System (ACS), is no longer available for these specific transactions. May 20, 2016: Full transition of legacy AESDirect (export commodity filings via the portal) to ACE. May 28, 2016: Filers required to file in ACE electronic entries (cargo release) for the most commonly filed entry types, and Foreign Trade Zone entries and entry summaries. The legacy system, ACS, is no longer available for these specific transactions. June 15, 2016: Mandatory filing of ACE electronic entries and entry summaries with Food and Drug Administration (FDA) data. At this point, all electronic entries and entry summaries that do not have quota merchandise should be filed in ACE. July 23, 2016: Mandatory filing of ACE electronic entries and entry summaries for remaining entry types, specifically those entry types involving quota merchandise. August 27, 2016: Mandatory use of ACE for electronic Protests. September 20, 2016: Mandatory filing of National Marine Fisheries Service (NMFS) data electronically. October 29, 2016: Filers will be required to file in ACE and no longer able to file in ACS all remaining electronic portions of the core CBP cargo process, including Duty Deferral, Drawback, Reconciliation, Collections and Liquidation. The AMS pilot is ongoing with two filers at the Ports of Philadelphia and L.A./Long Beach and will continue until NPRM and subsequent final rule are published amending 7 CFR parts 51, 52, 944, 980, and AMS anticipates the rate of pilot expansion will greatly accelerate if the current pilot continues successfully and no issues are uncovered to delay the expansion. APHIS Core: Final rule is published. FRN to conclude pilot was published July 18, 2016, concluding its pilot on August 15, 2016. ATF: An ATF pilot closing notice is expected by the end of August. CPSC: Pilot began in July 2016 and will continue throughout part of 2017. DDTC: The DDTC import license decrementing pilot is open and ongoing. The import license decrementing is working in the ACE system. Under the pilot, CBP is receiving feedback from the participants to enhance the messaging on the import filing transaction. Import totals are returned on the next export transaction (at this time). DEA: DEA pilot began August DEA’s NPRM is pending publication and is with OMB. The pilot will not conclude until the final rule is published. EPA-FIFRA: Pilot will continue until Final Rule is published. Mandatory date based on effective date in Final rule. The pilot opened to all filers on July 6, 2106 EPA-TSCA: Pilot will continue until final rule is published. NPRM is in review in C1’s office. Final Rule to be published after notice and comment period for NPRM. EPA-TSCA: Pilot will continue until a Final Rule is published. Mandatory date based on effective date in Final rule. The NPRM is pending publication. EPA-V&E: Pilot will continue until a Final Rule is published. Mandatory date based on effective date in the Final Rule. Getting Ready for ACE As the mandatory dates draw near, make sure you have taken all the necessary steps. Software Vendors and Self Filers Software configured to CATAIR guidelines on CBP.gov Software configured to supplemental PGA CATAIR guidelines on CBP.gov All capabilities tested in CERT Clients informed of software updates and aware of ACE transition Brokers Software package from vendor is updated for ACE transition Entries have been filed in ACE Cargo Release successfully Entry Summaries have been filed in ACE successfully Confirm software vendor has successfully tested all capabilities in CERT Importers Broker has updated software Broker can confirm that entries and entry summaries have been filed in ACE successfully (including new data elements for ACE entries/cargo release: Buyer Name and Address, Buyer EIN, Seller Name and Address, and Manufacturer/Supplier Name and Address) If you already transmitting data to CBP, you’ll need to make sure you have the following items completed or accounted for internal to your company. Importers: If your entry summaries aren’t being filed in ACE, talk to your broker about WHY they’re not filed in ACE, and WHEN the broker will file your entry summaries in ACE. Brokers: If your software vendor hasn’t provided software for ACE filing, find out WHEN they will have the software in place to support ACE filing. Don’t assume entries are filed in ACE. Confirm with vendor that they are going to ACE and not ACS.
