State Program Approval (SPA)
SPA is a process whereby EPA approves a “State UST Program” to operate in lieu of the federal UST program. State’s requirements must be no less stringent than the corresponding federal requirements.

SPA State vs non-SPA State
Non-SPA State – Federal authority and influence. Owners must comply with both federal and state UST regulations. SPA State - When EPA grants SPA to a State, federal regulations no longer are in effect. If EPA brings an enforcement action in that State, we enforce State Regulations.

What do these new requirements mean for owners and operators?
In states with SPA Continue to meet the state UST requirements until State adopts the federal requirements; or EPA withdraws approval of SPA for that state In states without SPA and in Indian country The new requirements will apply according to time frames specified in the 2015 UST regulation Indiana is a SPA State

Indiana SPA May 18, 2016 IDEM issued a notice of plans to update the UST rules Currently IDEM is drafting new UST rules Spring 2017 IDEM expects to send a draft SPA application to EPA EPA will review draft SPA application Summer 2017 IDEM anticipates to have the rules in place Fall/Winter 2017 IDEM submits final SPA application to EPA EPA approves SPA
