Law on Mining (“Official Gazette of Montenegro”, no 65/08, 40/11) among other things in general defines safety and protection measures for conduction of mining operations Law on Technical Requirements For Products And Conformity Assessment (“Official Gazette of Montenegro”, no 53/11) defines technical requirements for products, the assessment of product compliance with technical requirements, notification of technical regulations and conformity assessment procedures, etc.. Technical regulation for conducting of mining operations and requirements for products which are covered by the ATEX Directive are from the eighties and they were a part of the legal system of the former State of Yugoslavia. The Regulation is comprehensive and in detail manner defines requirements for products, start from the process of production, technical requirements, to the method of usage, but is outdated . ATEX Directive will be transposed into national legislation through a bylaw in accordance with the procedure defined in the Law on Technical Requirements For Products and Conformity Assessment Montenegro does not plan to establish an organization for evaluation of conformity for products covered by ATEX Directive. The State accepts Certificate of Conformity Assessment issued from foreign organization if they are issued in accordance with international agreements. The Ministry of Economy and Inspection Directorate with the Mining and Electroenergetic Inspectors will be responsible for performing the duties arising from ATEX Directive Authorization of Inspectors: to issue pecuniary fine, temporary confiscation of product, prohibition of usage and sale, submit criminal charges, etc. M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 1: Free Movement of Goods
