State Plan Updates and Discussion
Title I, Part D: Prevention and Intervention Programs for Children and Youth who are Neglected, Delinquent, or At-Risk Transitions Between Correctional Facilities and Local Programs (ESEA section 1414(a)(1)(B)): Provide a plan for assisting in the transition of children and youth between correctional facilities and locally operated programs. Program Objectives and Outcomes (ESEA section (a)(2)(A)): Describe the program objectives and outcomes established by the State that will be used to assess the effectiveness of the Title I, Part D program in improving the academic, career, and technical skills of children in the program. Did any of you have the chance to participate in the first ED webinar? Any major takeaways? Renewed emphasis on: Coordination and collaboration around transitions back to local schools and locally operated programs Attainment of H.S. Diplomas Youth in tribal institutions, including schools operated or funded by the Bureau of Indian Education (SP2) and engaged in child welfare Sec (Definitions) 1 of 4 changed AT-RISK.—The term ‘‘at-risk’’, when used with respect to a child, youth, or student, means a school aged individual who is at-risk of academic failure, dependency adjudication, or delinquency adjudication, has a drug or alcohol problem, is pregnant or is a parent, has come into contact with the juvenile justice system or child welfare system in the past, is at least 1 year behind the expected grade level for the age of the individual, is an English learner, is a gang member, has dropped out of school in the past, or has a high absenteeism rate at school.

State Plan Updates and Discussion
What are your next steps as you develop or revise your state plans? What needs do you have as you move forward? How can your peers and NDTAC help? Have you begun thinking about implementation and use of your plan? NDTAC conference session How will your states adjust policies and responsibilities according to your new plan (e.g. will applications, monitoring, or technical assistance change)? How are states slated for the first submission deadline faring? I think if there’s any room for a conversation about subgrantee monitoring I’m interesting in what groups do with SA monitoring. Do other states monitor at an institution, agency, or a mixture? What do they find is successful in building compliance and making positive gains?

Can an adult correction institution use funds for an institution wide project in any form or structure? I think the second bullet on 8 essential elements for an IWP plan seemed to open that door.

Recent TA Requests Response
According to TIPD regulations, TIPD funds can’t be used for institution-wide projects in adult correction institutions. However, collecting data on the academic needs of youth served in adult correction institutions is required for planning purposes.

Recent TA Requests Question:
The DC Department of Youth and Rehabilitation Services (DYRS) is asking whether the funds can be used for other children within DYRS but not placed at New Beginnings. We believe the funds are specifically for the children placed at New Beginnings; however, wanted to get clarification. Use of funds: Can DYRS use funds outside of New Beginnings programming at the facility. For example, DYRS has prevention and intervention programs (after school and during the day at the DYRS HQ). DYRS is the actual sub grantee – does the law allow for services to be provided at the SA/DYRS location vs. an actual juvenile justice facility, community day program or adult correctional facility.

Recent TA Requests Response:
Although the youth in question seem to be delinquent and/or at risk; TIPD regulations do not allow subpart 1 funds to be utilized for programs and activities provided outside of juvenile justice institutions, community day programs or adult correctional facilities. Also, these youth seemingly would not meet all of the annual count requirements (e.g., in program for youth who are N or D, including juvenile and adult correctional facilities and community day programs, and enrollment in a program that has an average length of stay of at least 30 days). On the surface, it sounds like the program DYRS is wanting to fund may be allowable under TIPD Subpart 2 funding. This route could allow DYRS use TIPD funds to provide prevention, intervention and academic support services to juvenile justice involved DC Youth who do not go the New Beginnings campus.

Would you like NDTAC to speak at your conference or webinar? Sample presentations are available on NDcommunities.org NDTAC will cover staff time; states are responsible for covering all travel costs (e.g., flight, lodging, meals, ground transportation and incidentals) Complete a request form by March 24, 2017; NDTAC will review the form and contact you. Under our current contract with the US Department of Education, we are pleased to offer the opportunity for our staff to present at your conferences on TIPD-related topics. Sample presentations that we have delivered at national, state and local conferences in recent years are available on NDCommunities.org: Under this contract, states are responsible for covering all travel costs associated with the presentation (e.g., flight, lodging, meals, ground transportation and incidentals), and NDTAC will cover staff time to the extent that our budget can allow. Due to these budget constraints, we are limited in the number of presentations we can deliver each fiscal year. If you would like your state to be considered, please complete a form by March 24, 2017 so that we can plan accordingly. Thereafter, we will consider new requests on a rolling basis depending on staff availability and budget constraints. Completing this form does not guarantee NDTAC’s availability to present. Please provide as much information as possible to help NDTAC understand your event and presentation needs. The details do not need to be set in stone at this point in time. If we are able to accommodate your request, we will work with you to develop and finalize plans for the presentation as needed.
