1.Legislation Accreditation body of Montenegro was established in march 2007 year by the Government of Montenegro. Accreditation body of Montenegro performs its activities according to: Law of accreditation (O.G. 54/09), Decree on Establishing the Accreditation Body of Montenegro (O.G 21/07), Statute of Accreditation body of Montenegro and Internal documents (12 rules and 7 procedures) Legal acts and Internal documents are consistent with: General and internal documents are consistent with the : Regulation EC 765/2008European paralinment and Council, Standard MEST EN ISO/IEC 17011:2010 –General requirements for the competence of testing and calibration laboratories Rules of EA, ILAC i IAF M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 1: Free Movement of Goods

Accreditation body of Montenegro has been officially appointed by the state of Montenegro as the only national accreditation body, as stated in Article 4 of the Law on Accreditation Accreditation body of Montenegro performs accreditation activities following principles of independence, impartiality and objectivity  Accreditation body of Montenegro tasks and responsibilities (given in Article 5 of the Law on Accreditation, Article 5 of the Decree on Establishment and article 11 of Statute) are clearly distinguished from tasks and responsibilities of other national authorities  Accreditation body of Montenegro is a non-profit organization, as stated in Article 4 of the Law on Accreditation, Article 2 of Decree on Establishment and Article 3 of Statute M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 1: Free Movement of Goods

Accreditation body of Montenegro does not own shares, or in otherwise have any financial or managerial interests in the conformity assessment bodies, as stated in Article 6 of the Law on Accreditation Accreditation body of Montenegro is not competing with other national accreditation bodies. In contrary, following the principle of cooperation, Accreditation body of Montenegro has signed bilateral agreements on cooperation with other national accreditation bodies Internal document Q2.10 Rule on cross-border accreditation describes Accreditation body of Montenegro policy on this matter and it is in compliance with Regulation (EC) 765/2008 General rules describing operation of Accreditation body of Montenegro and accreditation process, Annual work program, Annual report, Register og conformity assessment bodies with their scope of accreditation and another relevant information are available on Accreditation body of Montenegro website (according to Article 7 of the Law of Accreditation and Article 29 of Statute) M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 1: Free Movement of Goods

2. Personel Human resources of Accreditation body of Montenegro comprise of: - permanent staff and - external auditors and technical experts. Permanent staff have appropriate education, training, technical knowledge, skills and experience necessary for the type of work they perform All employees and externally assessor are obliged to respect the rules, including the aspects of confidentiality, independency and impartiality. In this regard, they have to sign a Code of conduct M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 1: Free Movement of Goods

Essential part of the accreditation system in Montenegro, a pillar on which the competence of Accreditation body of Montenegro is based are its assessors  Accreditation body of Montenegro permanently announces public call for assessors (evaluators and experts) on its website ( There are currently 9 lead assessors, 17 technical assessors and 17 technical experts in Accreditation body of Montenegro pool of experts (some of them are from neighboring countries) When it comes to development of new accreditation schemes, Accreditation body of Montenegro may engage assessors and experts from national accreditation bodies that are signatories of bilateral agreements with Accreditation body of Montenegro, signatories of EA MLA or signatories of EA MLA/MRA with ILAC or IAF M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 1: Free Movement of Goods

3. Training (EU founding Projects) From its established Accreditation body of Montenegro, permanent staff and its external assessors have been continuously trainedTraining was mainly organized within the framework of projects, such as : “Development infrastructure quality in Montenegro” -IPA 2007, “Development infrastructure quality in Western Balkan and Turkey” – Regional IPA 2008, ”Promotion regional cooperation South East Europe Evrope in field quality infrastructure “under the organization PTB (Physikalisch- Technische Bundesanstalt), “Development of Accreditation Services in Montenegro“ – Framework Contract Project M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 1: Free Movement of Goods

4.Register of conformity assesment bodies In Register of Accreditation body of Montenegro for the time being there are 19 conformity assesment bodies from which are: - 14 testing laboratories , - 1 calibration laboratory, - 3 inspection bodies and - 1 certification body. Accreditation has been lately recognized in Montenegro as a most comprehensive tool for granting competence and as a consequence there is increasing number of applicants for accreditation (areas: physical, chemical, microbiological testing of olive oils, wines, forensic testing, management system, noise testing, calibration scales, thermometers, temperature, mass, pressure, ....).  M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 1: Free Movement of Goods

5. Cooperation on national level Accreditation body of Montenegro participate in preparation of national technical legislation and provides relevant information to responsable authorities about accreditation system and accredited conformity assessment bodies Accreditation body of Montenegro expects even more intensive cooperation with responsable authorities regarding harmonization of national legislation with EU legislation Accreditation body of Montenegro maintains an effective cooperation with the Chamber of Commerce of Montenegro and quality infrastructure institutions, such as Bureau of Metrology of Montenegro and Institute for Standardization of Montenegro.  M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 1: Free Movement of Goods

Cooperation with EA Contract of cooperation between Accreditation body of Montenegro with EA (november 2008) Accreditation body of Montenegro was host of 26th General Assembly of EA (november in Budva) On 28th General Assembly of EA, held 23th-24th November 2011 in Warsaw (Poland), Accreditation body of Montenegro was promoted to a full member of the European Cooperation for Accreditation (EA) M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 1: Free Movement of Goods

Cooperation with ILAC - Assosiate member International Laboratory Accreditation Comitee - ILAC (april 2009 godine). Cooperation on national level - In line with the Agreement on Central European Free Trade Association "CEFTA 2006", Annex 1, Chapter IV - Technical barriers to trade, and in line with requirement to remove unnecessary barriers to trade (in terms of the Agreement on Technical Barriers to Trade of the World Trade Organization, WTO-TBT), Accreditation body of Montenegro has established bilateral agreements on cooperation in the field of accreditation with the Accreditation Body of Serbia (ATS), the Accreditation Directorate of Albania (DA), the Institute for Accreditation of the Republic of Macedonia (IARM), the Institute for Accreditation of Bosnia and Herzegovina (BATA), the Croatian Accreditation Agency (HAA)  M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 1: Free Movement of Goods

Plans of Accreditation body of Montenegro in future Signing EA MLA Full member in ILAC and IAF, signatory MRA Better cooperation with national authority and all stakeholders (ministries Government of Montenegro, market surveillance ,customs..) A prerequisite for the continuation of the successful development of the national accreditation body is continued support of the Government of Montenegro. The task of the national accreditation body is actually still continuing infill obligations laid down in Regulation 765/2008 (like the clear separation of duties and responsibilities of the national accreditation body of the other state institutions, the independence and impartiality ..) Active participate in work international and European assosiation for accreditation and continuous improvement of cooperation with the accreditation bodies in the region, for the full harmonization of accreditation M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 1: Free Movement of Goods

8.Conclusion The accreditation system in Montenegro has successfully established Accreditation body of Montenegro shall cooperate with all stakeholders in Montenegro Accreditation body of Montenegro maintains a very good regional cooperation  Accreditation body of Montenegro is a member of the European and International accreditation cooperation Accreditation body of Montenegro is promote accreditation like the most reliable evidence of competence M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 1: Free Movement of Goods
