5. Tribal Impact of T21: OTHER QUESTIONS Q 31: Does the tobacco 21 law apply to tribal lands? A. It depends. Federally-recognized tribes that engage in casino-style Class III gaming have compacts with the State of California. These compacts currently exempt those tribes from any state laws or regulations governing the use of tobacco. Most compacts do not exempt the tribes from state laws or regulations governing the sale of tobacco for use off the reservation, but a few set the minimum purchase age at 18 years. State minimum age law does not apply to the sale of tobacco by a tribal member to another member of the same tribe on their reservation. Tribes may adopt minimum purchase age ordinances and tribal members who operate retail outlets on tribal land may refuse to sell to individuals under 21.

Talk about presentation to Riverside Tobacco Coalition and meeting Paul Hinrichson and Bob Heinbaugh – have a connection with Agua Caliente tribe – Margaret Park – renovating casino at this moment in time. Perfect opportunity to meet with them and discuss smoke-free options. – I had met one of their tribal council members last year and discussed smoke-free/non smoking as they think about renovations. The can have up to 6 gaming facilities.
