3 1. Abuse Mitigation: Follow-up on GAC Advice
Background 2009 GAC endorsed Law Enforcement Due Diligence Recommendations PSWG seeking information on implementation ICANN 57 Hyderabad (3-9 Nov. 2016) Questions from the GAC to ICANN Board regarding implementation and enforcements of provisions in RAA, AGB, RA, as well as Due Diligence of ICANN in several areas (See Annex 1 of Hyderabad Communiqué) Well attended High Interest Topic Session (record 338 attendees) Next Steps Answers from ICANN expected by 3 February 2017 (5 weeks prior to ICANN 58 Planning of processing of answers and briefing of the GAC Scheduling time with GAC and Board during ICANN 58

4 2. Security Framework for Registries (Spec 11)
Background Framework for Registries to respond to Security Threats called for by an ICANN Board Resolution (June 2013) in response to New gTLDs Safeguards Beijing GAC Advice (April 2013) Drafting Team formed in August 2015, drafting initiated in Dec. 2015 Persistent challenge for Registries and PSWG to agree on substantive voluntary measures and standards Outcome of ICANN 57 2 Meetings with registries (Drafting Team), 1 meeting of PSWG Members only Registries proposed compromise revision of latest PSWG input Next Steps PSWG to propose subsequent draft of Security Framework Consider briefing of GAC in advance of ICANN 58

5 3. Consumer Trust & Consumer Choice Review
Background Part of regular reviews at ICANN (Affirmation of Commitments) Review Team formed in January 2016 To determine the extent to which the introduction of new gTLDs has promoted competition, consumer choice and consumer trust in the DNS. To assess the effectiveness of (a) the application and evaluation processes, and (b) safeguards put in place to mitigate issues Update and Next Steps CCT Review Team release a blog post on interim findings and next steps Draft Report to be released in December 2016 More information on the Review Team’s wiki page

6 4. Privacy Proxy Services Policy Implementation
Background As a follow-up to the 2013 RRA negotiations, the GNSO conducted a Policy Development Process on the issue of accreditation of Privacy and Proxy Services Providers (Oct – Jan 2016) The GAC Helsinki Communiqué (June 2016) advised the ICANN Board on public policy concerns that should be addressed as part of implementation, in particular: Confidentiality of law enforcement and consumer protection requests Need for consideration of cross-border issues Access of Privacy/Proxy Services to domains engaged in collection of money In August 2016, the ICANN Board adopted the policy recommendations In October 2016, an Implementation Review Team (IRT) was formed to assist ICANN in its implementation effort, several GAC and PSWG members joined as volunteers Update and Next Steps ICANN Board expected to deliberate on the Helsinki Advice during its next meeting on 13 December 2016 (Agenda) Suggested drafting by GAC/PSWG volunteers of a straw man proposal for a Law Enforcement Disclosure Framework, for consideration by IRT

7 5. Whois/Registration Directory Services
Next Generation RDS PDP Working Group Background The RDS PDP was Launched in November 2015, following the work of the Expert Working Group on gTLD Directory Services (Final Report in June 2014) To deliberate in 3 phases, including on whether or not a new RDS system is needed As of Oct there were 7 GAC and 4 PSWG representatives in the Working Group Status The working group developed preparatory documents for its deliberations, including: a Problem Statement, a set of Example Uses Cases, and a Draft Statement of Purpose for Registration Data and Directory Services The Working Groups is currently refining its methodology to deliberate on the hundreds of potential requirements it identified for a Next Generation PDP Next Steps Working Group to release its First Initial Report (no date known yet)

8 5. Whois/Registration Directory Services
RDS Review Team Background Review mandated by the new ICANN Bylaws (Article 4.6) to review enforcement of ICANN policies relevant to RDS and explore structural changes to improve accuracy and access to gTLD registration data Following 1st Whois Review Team (Final Report was published in May 2012) Feedback on Limited Scope Proposal Proposal: Limit scope to reviewing implementation of 1st Review recommendations Feedback to date in the GAC : Review Teams should determine the scope of their work Self-assesment by ICANN should not be the basis of a Review Team’s work Next Steps SO/AC leaders to consider feedback from the Community on limited scope proposal Ongoing Call for Volunteers, deadline for application now 13 January :59 UTC

9 6. New gTLDs and Child Protection
Background and Outcome of ICANN 57 John Carr circulated a paper prior to ICANN 57 Feedback from PSWG Working Session in Hyderabad (Transcript) Interest in shortfalls of Spec 11 and work of CCT Review on this matter (Australia) Interest in costs associated with Nominet’s implementation, and extent of TLDs to be considered (UK) Consider developing detailed provisions to apply to registries (US FBI) Concerns with risk of engaging ICANN in content regulation as well as sensitivities around how different countries deal with child online protection (US) Next Steps Develop documentation further Plan appropriate meetings during ICANN 58 Involvement of PSWG Members in New gTLDs Subsequent Procedures PDP

Background GNSO PDP initiated on December 2015 PDP Working Group tasked with determining what changes (if any) may need to be made to the existing policy recommendation on the Introduction of New gTLDs Relying on various studies and reviews (such as the CCT Review) Outcome of ICANN 57: Several issues of potential interest to the PSWG Registry Service Providers Accreditation Single vs. categorized Registry Agreement Continued Operations and Emergency Back-End Registry Operators Due diligence on technical competence and financial capability (at application time or upon signing of Registry Agreement with ICANN?) Improvement of evaluation criteria and process Name Collisions and Identification of High Risk strings Next Steps Interested PSWG members to join the PDP Working Group and relevant Work Tracks

11 7. ICANN 58 Planning Planning has started for the ICANN 58 Meeting
GAC Leadership will discuss agenda setting this Thursday 15 December 2016 Briefings for consideration by the GAC before ICANN 58 due on 27January 2017 GAC Secretariat is expecting feedback from GAC Working Groups by Wednesday 14 December 2016 PSWG expectations and needs Decisions and endorsements needed from the GAC Meetings with the GAC Plenary (number and duration) Number of PSWG working sessions and preferred timing (Early morning before plenary, on Saturday Morning, on Monday ?) Content: introduction of membership, showcasing accomplishments, information on current initiatives and issues writing on invitation by "guest" subject matter experts, etc. Any ideas/contributions from PSWG Members ? Update of the ICANN Guide for Law Enforcement Turning the current guide into a living document Possibly fed by/feeding into the Newsletter
