2 What is extended producer responsibility (EPR)
Producer’s responsibility for a product is extended to the post consumer stage of a product’s life cycle Producers take over the responsibility for collecting or taking back used products for treatment (incl. re-use, recycling, recovery and proper disposal) Incentive to take into account environmental considerations along the products' life, from the design phase to their end-of-life Support of the EU Waste Hierarchy Actors involved in the product value chain: manufacturers and importers, retailers, consumers/end users, local authorities, public and private waste management operators, recyclers and social economy actors

3 EPR coverage and organisation
Products covered according to EU legislation: Electrical and electronic equipment (EEE), Batteries and accumulators (BA), Vehicles Packaging Additional products covered in some countries – textile, oils, tires, farm plastics, medicines, etc. Ways of discharging obligations: Individual Extended Producer Responsibility Organization (IEPRO) Collective Extended Producer Responsibility Organization (CEPRO) CEPRO or IEPRO may be established for one or more categories of EEE or type of BA

4 EPR coverage and organisation
What is… Individual Extended Producer Responsibility Organization (IEPRO)?: non-profit legal entity individually fulfils his obligations on organizing and financing collection, sorting, transport, recycling and treatment of WEEE and WBA Collective Extended Producer Responsibility Organization (CEPRO)?: non-profit organization operates on the principle of shared responsibilities of its members fulfils the obligations of two and more producers in organizing and financing the collection, storage, sorting, transport, recycling and treatment of WEEE and WBA CEPRO implements the EPR principle on behalf of the producers

5 EPR variety in implementation
Various implementation in terms of: Organisational aspects of CEPRO Competition (one or more CEPRO) Collection, recycling and recovery rates EPR schemes managed by one single PRO EPR schemes managed by several non -competing PROs (e.g. they cover different product categories) EPR schemes managed by several competing PROs In addition to the number of competing PROs, the possibility and existence of individual compliance schemes is also to be considered Fees Cost effectiveness Data availability and confidentiality Identification of free riders and enforcement Surveillance of treatment operations and CEPRO

6 EPR functions and implementation
CEPROs/IEPROs potentially exert these main functions: Financing the collection and treatment of the product at the end of its life (targeted waste stream) by collecting fees and redistributing the corresponding financial amounts Managing the corresponding data Organising and supervising these activities Communication campaigns Costs and performance are influenced by : Population density and country geography Historical development of the waste management infrastructure Value of secondary materials on the national market Awareness and willingness of citizens to participate Existence of complementary waste policy instruments, especially economic instruments like pay-as–you -throw schemes and landfill taxes Fair competition The full net cost of EPR systems covers collection, sorting and treatment costs of waste management minus revenues from recovered material sales

7 Establishment and functioning of CEPROs/IEPROs
CEPRO/ IEPRO shall be registered in the respective Register Members of CEPRO can be only producers of EEE or BA that are already registered in the Register of producers CEPRO cannot refuse the producer of EEE or BA to become its member if the producer complies with its membership requirements A producer shall be a member only of one CEPRO for a certain category of EEE or type of BA Members of CEPRO have equal rights. Producers of EEE or BA who established CEPRO shall not have competitive advantage to the other members Neither CEPRO nor any of their members shall conduct any kind of economic activities in waste management operations in the sphere of WEEE or WBA

8 Obligation of members of PROs
Obligations of the members of CEPROs: Provide information to CEPRO on quantities of EEE or BA placed on the market Pay a financial contribution to the CEPRO according to their market share per EEE category or BA type to cover the costs on fulfillment of obligations in the sphere of waste management Costs of CEPRO members incurred for the fulfillment of obligations may be included in the price of EEE or BA.

9 Establishment and operation of IEPRO
For fulfillment of obligation CEPRO shall enter into contracts with: waste management economic operators that have relevant authorization documents and comply with the requirements under this Law distributors local self-government authorities Owner and employees of IEPRO cannot act in the interests of other CEPRO or IEPRO IEPRO finances all the costs related to fulfillment of obligations Costs of IEPRO incurred for the fulfillment of obligations may be included in the product price

10 REGISTER, INTEGRATED INFORMATION
SYSTEM AND REPORTING Establishment and operation of the Register - following sections: Register of producers Register of CEPRO and IEPRO Register of waste management economic operators Integrated information system - formats specified in the legislation Annual reports of CEPRO and IEPRO: quantities of EEE or batteries/accumulators placed on the market by categories or types (consolidated data for all members of CEPRO) waste quantities collected and treated by categories fulfillment of the minimal targets for separate collection, recovery and recycling contracts with waste management economic operators, distributors and local self-government authorities
