3. DEFINITION ( As per the Juvenile Justice Board of India): Juvenile delinquency refers to the antisocial or criminal activity of the child (below 16 years of age for boys and 18 years for girls) which violates the law. The term 'juvenile' has been defined in clause (h) of Section 2 of the Juvenile Justice Act, This has been a topic of debate for a long time but due to increase in the number of heinous crimes committed by juveniles in the recent past, it has come into spotlight. Currently, it is the need of the hour to find a way to stop the crimes of this manner and to stop the upcoming generation from treading into the wrong path. Also there is a question of whether punishing a juvenile is right or wrong and about the level of punishment when charged guilty Through the course of this discussion we will look into this issue from five different perspectives namely the juvenile’s, the parents, the society’s, the judiciary and the human rights groups.

5. Issue: background or origin

6. In India, the first legislation dealing with children in conflict with law or children committing crime was the Apprentices Act, It provided that children under the age of 15 years found to have committed petty offences will be bounded as apprentices.
Later on the Parliament enacted the Juvenile Justice (Care and Protection) Act, 2000 which raised the age bar to 18 years for both girl and boy.

10. The reported cases of juvenile delinquency has gone up by 3
The reported cases of juvenile delinquency has gone up by 3.5% from to 2014.
The ratio of girls to boys apprehended under IPC crimes was nearly 3:97 during 2014.
Most of the cases of juvenile delinquency have not yet been disposed (36% approx.).
Nearly 18% of the total apprehended juveniles were sent to rehabilitation centres.
After the Nirbhaya case, the public concern over such cases has been increased and the question of giving capital punishment to juveniles was raised.
After the above case the upper bar for juvenile age group was brought down to 16 years.( For boys)

12. Issue : Future Status

13. - The juvenile court IN the future WILL FUNCTION as society’s most significant enterprise.
-The court’s jurisdiction will have an active role in child welfare cases.
-The court will create a juvenile justice system which addresses the full range of delinquency, status offenses, and child abuse and neglect cases.

                       3.Detention reduction
                       4.Humane and rehabilitative juvenile facilities
                       5.Evidenced based practices,
Hence, This is the future.
