8 Mumbai Port Trust Obligations
Port may provide place for additional berth for afloat repair, other than operational area on berth, subject to availability on payment of applicable tariff of port as mentioned in Schedule of rates (SOR) Only Administrative support and obtaining clearance from any statutory authority, shall be provided by port. On successful completion of all the obligations under the contract and on the request of the Licensee, a “Performance Certificate will be issued by CME, MbPT. Port will not give any guarantee of business and shall not take any responsibility of recovering additional ship repair charges from customers. 9 Prominent Licensee Obligations (Private Party)
Ensure third party insurance as well as vessel/port structure etc. covering each incidents/acts from the date the FDD & other equipment is brought inside the port area and it’s validity should be kept 1 month after the completion of license period. Insurance should cover salvage liability of the Floating Drydock Install and operate the FDD at their own risk and cost. No responsibility of Port for any damages to FDD or to the men deployed for operating FDD along with other equipment Obtain all clearances and approvals from the statutory authorities. Port shall not be responsible for any loss/damage etc. occurring due to delay in obtaining and/or not granting permission or approvals Nominate an authorized representative through Power of Attorney for all the transactions with port Only used as Ship repair not as any Common User Facility Persons engaged for the work are clear from Security angle i.e Police NOC. License from IRS or other equivalent IACS body (class certificate) for ship repair Follow all labour related law and regulations or any other applicable Acts prescribed under state & central government Pay damage rectification cost for the damage caused to port properties due to his fault, negligence. 10 Prominent Licensee Obligations (Private Party)
The licensee shall conform to and be bound by all the rules, regulations and bye-laws relating to operations, maintenance, and the like which may be prescribed from time to time by Port Trust. Always available for inspection from licensor or his authorized agents or any other statutory agencies The Licensee at his own cost shall be solely responsible for the following: Co-ordinate with outside agencies for obtaining permission/approval/clearances etc. and with the port users that may be required for the operation. Pay all the taxes, duties, cess, fees, levies and all other dues imposed by any authority of India or abroad as the case may be. Keep the work site free from obstructions. Arrange for transport, gate pass, accommodation, medical facility etc. for the workmen deployed under this contract at his own cost. 12 Conclusion Conclusion
Demand supply gap exists in ship repair infrastructure in the Mumbai region. Ships deployed in Mumbai Offshore, coastal trade and coast guard forms majority of market Potential exists of other category of ships such as tugs, mini bulk carriers, etc. Development of ship repair yard in Indira Docks is technically and commercially viable. No need of financial assistance from government in the form of grants, subsidy or viability gap funding MbPT is estimated to generate an annual revenue of INR 2.7 Crores in the 1st year from ship repair at FDD.
