Negligence Most common type of civil action in court
Tort means “a civil wrong against another person” This is an act that can cause injury to another person This act should be avoidable

Negligence To win an case for negligence, it must go through the 4Ds
Duty – the existence of a duty of care Dereliction – breach of the duty by failing to live up to a standard of care Damage – damage is suffered Direct – connection between the act or omission and the damage

Duty of Care “A moral duty to anticipate possible causes of injury or illness and do everything reasonably practicable to remove or minimise these possible causes of harm”. Ref.Communicate and work effectively in health. Whiting Glenda 2009.

Confidentiality Confidential, private or sensitive information should not be divulged to any unauthorised person Confidentiality agreements are signed on commencement of employment, these are legally binding documents Ramifications of breach of confidentiality are usually instant dismissal

Confidentiality Organisations have in place:
Sound recruitment and staff selection, including police checks Induction training and annual refreshers Audits Security systems

Confidentiality Privacy of individual’s details at all times
Includes age, gender, address, date of birth Health issues, family information

Confidentiality Staff access is determined by job role
Staff may have ID access Computer access is monitored and restricted Documents should be private and confidential, stored correctly, disposed of correctly Under privacy act clients may access their own health information Activity 2.3 page 21
