2 APPLICABLE ISSUANCES DDB Reg. No. 3 s. of 2017 "Strengthening the Implementation of Barangay Drug Clearing Program" DILG Memo. Cir. No "Revitalization of the Barangay Anti-drug Abuse Council (BADAC) and their Role in the Operations."

3 MANDATE OF THE BARANGAY
Section 1 DDB Reg No. 3 s. 2017 "xxx shall render assistance to the law enforcement agencies in the eradication and clearing operations of illegal drug."

4 MANDATE OF THE BARANGAY
DILG MEMO CIR The elected barangay official present during the operation shall execute an affidavit act as witness in court hearings in the prosecution of drug cases.

5 MANDATE OF THE BARANGAY
CHAPTER IV, SEC. 39 (20) OF RA 7160 Mandates that all barangays shall adopt measures towards the prevention and eradication of drug abuse

6 CLASSIFICATION OF BARANGAYS
The following classification of barangays shall be observed in determining the priority areas for clearing operation. Section 7 DDB Reg No. 3 s. 2017

7 CLASSIFICATION OF BARANGAY
DRUG UNAFFECTED BARANGAY DRUG AFFECTED BARANGAY A. Seriously Affected - presence of clandestine drug laboratory, warehouse, marijuana plantation and drug den/tiange - presence of drug trafficking or smuggling activity and personality

8 CLASSIFICATION OF BARANGAY
B. Moderately Affected - presence of drug pusher/s and/or user/s C. Slightly Affected - reported presence of drug users

9 WHO CAN DECLARE A BARANGAY AS "DRUG-FREE"

11 WHO CAN DECLARE A BARANGAY AS "DRUG-CLEARED"

13 WHAT IS THE COMPOSITION OF THE OVERSIGHT COMMITTEE

14 OVERSIGHT COMMITTEE Chairperson : Regional DirectorPDEA or rep.
Vice-Chairperson : DILG Regional Director or rep. Members : PNP representative DOH representative LGU rep. as appointed by the local chief executive

15 WHAT ARE THE DUTIES AND FUNCTIONS OF THE OVERSIGHT COMMITTEE

16 DUTIES AND FUNCTION Declare a barangay as DRUG-FREE.
Conduct regular monitoring of the anti-drug initiatives of all local government units. Conduct quarterly validation on the status of all drug-cleared barangays to ensure that the same is still drug free.

17 DUTIES AND FUNCTION 4. Direct the BADAC to conduct house visit on the identified drug personality for consideration of his/her serender and intervention. 5. It is authorized to conduct drug test on those drug personalities and surrenderers undergoing treatment, counseling, after-care and rehabilitation.

18 DUTIES AND FUNCTION 6. It is authorized to revoke all drug-free certification through official notice in case that a barangay fails to maintain all requirements of a drug-free barangay.

19 PROCESS OF CERTIFYING THE DRUG-CLEARED STATUS OF A BARANGAY

20 ASSESSMENT AND VALIDATION BY THE OVERSIGHT COMMITTEE
ISSUANCE OF A DRUG CLEARED CERTIFICATE DRUG CLEARING OPERATION The certificate shall be attested by the Chairman, CADAC/MADAC, certified by the Chief of Police and validated by the PDEA Regional Director

21 IS THERE AN AUTOMATIC REVOCATION OF THE DRUG-CLEARED STATUS OF A BARANGAY

22 NONE Upon validation of the Oversight Committee the barangay concerned shall be given 30 days to take appropriate action pursuant to Sec. 10 (4). (HOUSE VISIT)

23 PENALTY FOR NON-COMPLIANCE WITH DDB Reg. No. 3 s. 2017

24 PENALTY FOR NON-COMPLIANCE
1. Failure to appropriate substantial portion of their respective Annual Budgets as mandated by Sec. 51 in addition to the provisions of Sec. 324 of the Local Government Code - Disapproval of annual budget and admin. case for dereliction of duty pursuant to Section 60 of the LGC and Sec. 32 of RA 9165

25 PENALTY FOR NON-COMPLIANCE
Failure of other government employee and official to conform with the duties as mandated by the regulation shall be a ground for appropriate charges. Engaged in any illegal drug activity - charged criminally and administratively
