Hickory State's coach, Norman Dale, stops by the compliance office during week seven of summer access. Coach removed student-athlete Buddy Whit from the team due to a student conduct issue. He hands you a scholarship cancellation form. Coach Dale is worried. Managing the student conduct incident. Who is playing point guard?!? What are coach Dale's options?

An Altruistic Proposition
One of coach Dale's seniors has an amazing job offer at an investment banking firm. The firm will pay off any student loans he has, so he offers to give up his scholarship to help coach Dale recruit another student. Coach Dale wants to go recruit two transfers. How do you respond?

Was it issued in accordance with regular policy? Is the award academic-based? If so, can the scholarship be exempted? Are other student-athletes receiving the award? Is the scholarship at all based on athletics?
Outside Awards First question: Is the scholarship at all based on athletics? Yes? What institutions could the recipients attend? Is there a connection between the donor and your institution? Is the donor an outside sports team or organization? If so, did the student represent that team or organization in competition? Bylaw

Outside Awards Outside aid is unrelated to athletics if:
Applicants are not required to list athletics participation; and The awarding agency does not consider athletics participation. January 4, 2017 Staff Confirmation.

Counting Outside Awards
If unrelated to athletics, the aid is permissible. Permissible outside awards. Count against individual limitations. Do not count against team limitations. Outside aid based in any degree on athletics that does not satisfy Bylaw is not permissible aid for student-athletes.

Does the student's financial aid package exceed cost of attendance? PROCEED TO THE EQUIVALENCY What aid is countable? What is it costing the student to attend this institution?

Autonomy Legislation. If eligibility remains, aid cannot be cancelled or not renewed for athletics reasons. Jimmy’s graduation is a nonathletics reason to not renew his scholarship. Jimmy’s voluntary withdrawal renders him ineligible to compete. Making nonrenewal permissible. Nonautonomy Legislation. Can nonrenew for any reason after the period of the award. Bylaw

He didn't expect Jimmy to be on scholarship next year, so he's looking at a potential over-award situation…again. You start researching waiver precedent. What pieces of information are likely important?

Do the campuses share an administration? Do they have the same academic policies? Do they have the same admissions process? Are transcripts and degrees administered by one campus?

Aid To Attend Another Institution
Athletics aid to attend another institution is impermissible. Legislative Relief Waivers Does the institution accept the course? Is the course necessary? Will it help the student-athlete get closer to graduation? Is another course an acceptable replacement? How close is the student-athlete to graduation? Will the student-athlete have to return to your institution?

Completing A Summer Course
Cannot provide aid to attend another institution's summer course. Student Assistance Fund? Is not athletics aid; Is not precluded from being used for this purpose. Student Assistance Fund can be used for Jimmy to complete a summer course at another institution. Provided the conference agrees. Bylaw
