The University of Windsor Act s.5 The management and control of the University shall be vested in a non- denominational board of governors s.21 Except in such matters as are assigned by this Act to the Senate and the boards of federated and affiliated colleges, the government, conduct, management and control of the University and of its property, revenues, business affairs are vested in the Board, and the Board has all the powers necessary or convenient to perform its duties and achieve the objects and purposes of the University, including, without limiting the generality of the foregoing, power,

S.27 the Senate has power: To make regulations regarding the academic qualifications for appointment and promotion of the members of the academic staff of the University….. 11 Senate Bylaws Bylaw 40: Administrative Academic Units 4.1 Councils

16 Senate Policies Conflict of Interest Policy Conflict of interest:
Acting or appearing to act in a manner that seeks to advance or has the effect of advancing her/his own self interest or the interests of others in a way that is detrimental or potentially harmful to the interests, integrity or fundamental mission of the University.

Arises when a member allows his or her obligations or activities outside and beyond the terms of his or her employment at the university, interfere with the member’s employment at the university, or, when a member allows his or her obligations or activities outside and beyond the committee of which he/she is a member, interfere with the work of that committee.

MY POSITION – NEW AT THE UNIVERSITY – WAS CREATED IN RESPONSE TO PREMIER’S SV ACTION PLAN PROVIDE SUPPORT FOR CAMPUS COMMUNITY ACCOMODATIONS REFERRALS & RESOURCES GUIDANCE FOR SURVIVORS WHO WANT TO FILE A REPORT WITH THE UNIVERSITY OF WITH THE POLICY I AM ALSO RESPONSIBLE FOR OVERSIGHT OF SEXUAL MISCONDUCT POLICY & SV EDUCATION ON CAMPUS BUT MOSTLY… MY JOB INVOLVES A LOT OF LISTENING PRIOR TO THIS I SPENT FIVE YEARS DOING ACADEMIC WORK - TEACHING AND CONDUCTING RESEARCH ON SEXUAL VIOLENCE, WHICH IS WHAT LED ME TO WHERE I AM NOW. THE PERSPECTIVE THAT I BRING TO YOU TODAY IS INFORMED BY MY OWN PERSONAL EXPERIENCE OF WORKING WITH SURVIVORS, BUT IT IS ALSO REALLY GROUNDED IN RESEARCH. CLICK

21 Sexual Misconduct Complaints

22 What is Sexual Misconduct?
Sexual misconduct is an umbrella term encompassing all forms of sexually inappropriate behaviour and sexual violence. These include, but are not limited to, sexual harassment, sexual assault, threat of sexual assault, criminal harassment (including stalking and cyber harassment), relationship violence and gender based misconduct. 

23 Examples of sexual misconduct, which may be verbal, non-verbal or physical include, but are not limited to:  Unwelcome sexual advances  Unwanted attention  Implied or expressed rewards or benefits for sexual favours and implied or expressed threats if sexual favours are denied Requests for sexual favours  Unwelcome remarks and/or vexatious comments about someone’s sexuality, appearance and bodily presentation, gender or gender expression Non-consensual communications of a sexual nature (face-to- face, phone, , social media) Threatening or obscene gestures  

24 Reporting Options

25 DISCLOSURE REPORT COMPLAINT
A survivor or bystander may choose to disclose sexual misconduct to any faculty or staff member. Disclosure, in these circumstances, is about seeking support and/or guidance. This disclosure normally does not trigger an investigation or formal procedure, but may result in accommodation. However, disclosure of sexual misconduct to a member of University administration may trigger an investigation or formal procedure.

Maintain confidentiality - if you cannot maintain confidentiality, let them know as soon as possible. Notify the Sexual Misconduct Response & Prevention Office of the disclosure and seek consult if needed.
