BACKGROUND Montenegro has ratified the United Nations Framework Convention on Climate Change (UNFCCC) by means of succession, on 23rd October 2006 (Official Gazette of SRJ – International agreements No. 2/97), with date of entry into force of 21st January 2007 Montenegro is a non-Annex I party of the Convention M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT AND CLIMATE CHANGE Chapter 27: ENVIRONMENT

BACKGROUND Montenegro ratified the Kyoto Protocol on 27th March 2007 (Official Gazette of Montenegro No 17/07) Montenegro will align itself with the EU position and actions in regards to ratification of the Doha amendment to the Kyoto Protocol Ministry of Sustainable Development and Tourism has general competencies in the area of Climate Change M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT AND CLIMATE CHANGE Chapter 27: ENVIRONMENT

Chapter 27: Environment Climate Change EU ETS in MONTENEGRO Transposition of the EU ETS legislation is at early stage i.e. planning of the transposition Currently Montenegro does not have institutional setup in place for the implementation of the EU ETS, except for the national aircraft operator, Montenegro Airlines, which is included in the ETS from aviation activities MRV system in line with EU ETS is yet to be established M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT AND CLIMATE CHANGE Chapter 27: ENVIRONMENT

EU ETS in MONTENEGRO The list of potential ETS installations in Montenegro and the corresponding criteria for inclusion (taken from Guidance on interpretation of Annex I of the EU ETS Directive) Thermal (coal-fired) power plant Pljevlja-Combustion of fuels in installations with a total rated thermal input exceeding 20 MW Podgorica Aluminum plant-Production of primary aluminum Steel mill Niksic-Production of steel including continuous casting with a capacity exceeding 2,5 tones per hour Molson Coors Brewing, production of beer-Combustion of fuels in installations with a total rated thermal input exceeding 20 MW Vektra Montenegro, wood processing-Combustion of fuels in installations with a total rated thermal input exceeding 20 MW M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT AND CLIMATE CHANGE Chapter 27: ENVIRONMENT

Chapter 27: Environment and Climate Change EU ETS in MONTENEGRO-transposition plans Ministry of Sustainable development and Tourism (MSDT) will start in 2014 drafting of the legislation which will transpose EU ETS into national legal framework and which will designate competent authorities for the implementation and enforcement MSDT will in parallel coordinate and conduct necessary capacity building programme for the relevant national institutions and for the business and civil sector In its action towards achieving full compliance with EU ETS MSDT will rely on the support of the EU and its instruments (IPA, TAIEX) and in particular the future programme ECRAN M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT AND CLIMATE CHANGE Chapter 27: ENVIRONMENT

Chapter 27: Environment and Climate Change EU ETS in MONTENEGRO- transposition challenges Establishment of economy-wide system for monitoring, reporting and verifying (MRV) of the GHG emissions Accreditation of verifiers Institutional setup for implementation Human capacities Financial resources – Some preliminary rough estimates are provided through Twinning Project: Support to Environmental Management MN/08/IB/EN01, but it shall be further elaborated through Ntaional Strategy in the area of climate change M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT AND CLIMATE CHANGE Chapter 27: ENVIRONMENT

Chapter 27: Environment and Climate Change EU ETS FROM AVIATION ACTIVITIES in MONTENEGRO In line with requirements of the Directive 2008/101/EC as to include aviation activities into EU ETS national aircraft operator MONTENEGRO AIRLINES (MNA) is part of the scheme from 2010 The Administering Member state in respect of MNA is Germany and its EU ETS national authority DEHSt M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT AND CLIMATE CHANGE Chapter 27: ENVIRONMENT

Chapter 27: Environment and Climate Change EU ETS FROM AVIATION ACTIVITIES in MONTENEGRO National aircraft operator (MNA) has the necessary institutional setup which allow for participating in the EU ETS: Designated personnel to prepare monitoring plan (2 persons) Designated personnel to prepare report on emissions(2 persons) Operator holding account has been activated and primary and secondary account representatives have been appointed M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT AND CLIMATE CHANGE Chapter 27: ENVIRONMENT
