7 What is a Canvass? FIVE Potential Canvasses
A canvass confirms the official number of ballots cast and the final total of votes per candidate. It confirms or amends the election night results Allows for time to evaluate and verify any provisional ballots cast and add those to the election night results for the official total if approved Allows time for someone who had insufficient photo voter ID to cure their provisional ballot Allows time for any overseas or military ballots to be received and counted FIVE Potential Canvasses Primary County & Precinct – races entirely within the county “Local Canvass” Statewide & District – races in more than one county Precinct by Precinct – the results for each candidate in each voting precinct Runoff Runoff Precinct by Precinct

8 How do I Canvass? Where do I get the data? What do I do with the data?
Contact the county clerk or county election officer who will provide you with the results Overall Data Total number of voters who voted Total number of provisional ballots cast Total number of provisional ballots counted Candidate Specific Data Number of votes for that candidate in the county What do I do with the data? Submit those numbers on the SOS Will be transmitted to RPT as well.

Post results for Statewide & Multi County offices on SOS Website. 10 County & Precinct March 7th – Deadline to post notice of the local canvass The canvass is NOT required to be held in the county seat (NEW LAW) The county chair determines the time and place March 9th – Deadline to post notice of ballot drawing for County & Precinct races in the Runoff Must be posted on the County Commissioners’ Bulletin Board AND on the County Party website if applicable March 10th Canvass conducted for ALL Offices Ballot Draw for County & Local offices in the runoff election

11 Statewide & Multi County
March 11th – Deadline for County Chair submit the canvass results for statewide & multi county races to RPT/SOS March 13th – Deadline for RPT to hold State Canvass RPT must certify the names in the Runoff Election to the County parties as soon as possible March 14th – Deadline for RPT to certify State Canvass RPT must certify the names in multi county & statewide races in the Runoff Election to the County parties ASAP March 14th – Deadline to post notice of the statewide & multi County Runoff races Notice must be posted On the County Commissioners’ Bulletin Board AND on the County Party website if applicable March 17th – Statewide & District Runoff Election Ballot Draw

12 Precinct by Precinct March 31st – Deadline for County Chair submit PRIMARY precinct by precinct canvass to SOS New Law – the County Clerk will prepare the results but the County Chair must submit them to SOS electronically June 23rd – Deadline for County Chair submit RUNOFF precinct by precinct canvass to SOS

13 FAQs May I post all three notices at the same time?
Yes!  The first deadline is Monday, March 7th so make sure you post them on or before that day. Does the County Chair have to be present to canvass the vote? No – a member of the CEC Does the CEC have to be present to canvass the vote? No but they can be. A new state law says that if someone was elected by the CEC to represent the whole at the canvass with the county chair that person does have to present. Does the County Chair have to be present to hold the runoff ballot drawing?

14 FAQs Who can attend the ballot drawing?
The ballot drawing is an open meeting and anyone can attend including candidates and media Do I submit the outcome of the ballot drawing to RPT? No.  Putting the info on the SOS website will also submit the info to RPT. However, you will want to submit it to your county election officer and to your election service to order/program your ballots for the runoff election Do I submit the canvass for local races to RPT? No.  You will only submit canvass results for multi county and statewide candidates to RPT/SOS What are precinct by precinct canvass results and who do I submit them to? There are different due dates and guidelines for submission of precinct by precinct returns.  NOTE: SOS will NOT release your final funding check if you do not submit these results

15 Upcoming Dates & Deadlines
February 29th – Deadline for county chair to post notices of changed polling places. (Sec ) March 1st – PRIMARY ELECTION DAY (Sec (a), (c)) March 1st – Prior to opening the polls, presiding judge of each precinct must post at each entrance to the building a notice of the time and place for convening the precinct convention; which must remain posted continuously through Election Day. (Sec ) March 1st – Prior to opening the polls, presiding judge of each precinct must post notice of precinct chairs declared elected. March 1st – Polls open from 7:00a – 7:00p

16 Upcoming Dates & Deadlines
March 1st – 7:00p – Deadline for receiving early ballots by mail And late early ballots cast by voters who became sick or disabled on or after Thursday, February 18, 2016 (Secs (a) & (c)) March 1st – 7:00p – 9:00p – First time precinct conventions may start (as determined by the CEC of each county) NOTE: May not start at a polling location until the last voter has finished voting. Permanent Precinct Convention Chairs have 3 days to submit their records from the Precinct Convention or their credentials could be taken away. (RPT Rule 22c1) March 2nd – Deadline that the general custodian of election records must deliver the ballot box(es) or transfer case(es) containing the provisional ballots (or provisional ballot affidavits when DRE systems are used), along with the Summary of Provisional Ballots and the List of Provisional Voters for each precinct to the voter registrar by this day. The general custodian of election records makes this delivery to the voter registrar during the voter registrar office’s regular business hours. (Secs , ; 1 T.A.C. §§ – & ) NOTE: For the primary election, if the voter registrar wants to take possession of the provisional ballots and forms on election night (Tuesday, March 1, 2016), the voter registrar must inform the custodian of the election records and post a notice of the election night transfer no later than 24 hours before Election Day. However, under this type of delivery, the voter registrar must go to the office of the custodian of election records and pick up the provisional ballots and forms. Also, note that the voter registrar may take possession of provisional ballots prior to election night if ballots are kept separate and may be provided without unlawful entry into ballot box. (1 T.A.C. §§ – ).

March 10th –Deadline for early voting ballot board to verify and count provisional ballots that were verified by the voter registrar. (Sec (a)) March 16th – 5:00 p.m. — Last day runoff primary candidates may withdraw from ballot. (Sec (a)) March 17th – Recommended date for county chair to submit the runoff primary ballot format to primary committee for its approval immediately after drawing.  March 17th – Recommended date for county chair to order runoff primary election ballots. (Sec ) March 19th – County and Senate District Conventions

March 24th – Deadline (RPT Rule 32) for the Permanent Chair of each County or SD Convention to submit: Certified list of Delegates & Alternates elected to State Convention Must be submitted on official excel spreadsheet from RPT List of passed resolutions Must be submitted in an editable electronic format NOTE: Failure to meet this deadline could result in removal of Permanent Chairs’ credentials at State Convention. March 25th – Recommended last day to order any additional election supplies necessary for the runoff primary election.

March 25th – Recommended last day for the county chair to appoint presiding and alternate judges for each precinct in which the primary election will be held in the county, presiding judges for the early voting ballot board and the central counting station, and personnel for the central counting station. (Secs , , & ) Written notice of the appointments must be given to the judges (Sec ) March 25th – JOINT PRIMARY RUNOFF – Recommended last day for the county election officer to appoint presiding and alternate judges from the lists provided by each county chair and to appoint the election clerks (Sec (c)) March 25th – Recommended date to order the lists of registered voters from the county voter registrar. (Sec )

March 30th – Deadline for county chair to deliver notice to the state chair and to the county election officer of the names of the persons elected as county chair and precinct chairs for the county. (Sec ) March 31st – Deadline for county chair to deliver to Secretary of State precinct returns of primary election for: statewide offices and the offices of U.S. senator, U.S. representative, state senator, and state representative Including precinct-by precinct returns for early voting. Secretary of State shall create and maintain an electronic system for submission of the report. (Secs & , as amended by House Bill 1073, 2015 Legislative Session) NOTE ON NEW LAW:  The county clerk will prepare the report however, the county chair will still submit the report to the Secretary of State. Section (as amended by Senate Bill 1073, 2015 Legislative Session)

Three sources of funding for the Primary Election Filing Fees from local candidates Filing Fees from multi district candidates The is the check from RPT that you should have already received or be on the look out for in your mailbox. If you do NOT receive a check by Friday me! Primary Finance from SOS You must file ONLINE with SOS to receive any funding! All monies from these sources of funding should be deposited into the Primary Election bank account!

23 Types of Funds Federal Funds
Funds that are subject to the source prohibitions, limits, and reporting requirements of the Federal Election Campaign Act (“FECA”) Kept in a separate account (“federal account”)

24 Types of Funds State Funds
Subject to Texas prohibitions, limits, and reporting requirements May be used for state and local elections and to pay the non-federal share of certain allocable expenses

25 Types of Funds Corporate and Labor Funds
Cannot be used to pay for ANY portion of campaign activity (federal or non- federal) Can only be used to pay for administrative and overhead expenses (legal, accounting, bank fees, etc.) or to administer a primary election or convention held by the party May not be accepted or expended within 60 days before a general election Kept in a separate account (“PTY-CORP account”) Can be used to pay for Convention costs

33 Cost of Conventions Do NOT “pass the hat”
Keep track of how much each person gave and collect ALL required Texas Ethics Commission (TEC) information! Name, Address, Phone, , Amount, Occupation & Employer Be careful how much CASH you accept from each person (only $100 per reporting period allowed) – checks are preferred. Do not force attendees to pay This is against the law “Suggested Donation” ok Put funds in a bank account Have the County Party open a bank account for that convention. This is not considered a political activity and thus corporate funds are acceptable for the purpose of holding the convention.

34 Delegate/Alternate Allocations
Outlined by RPT Rule 23A Delegates to County/SD Conventions 1 Delegate & 1 Alternate for every 25 votes or major fraction thereof within the precinct for Abbott in the last general election. 0 – 37 votes = 1D & 1A 38-62 votes = 2D & 2A Each precinct gets a minimum of 1 Delegate & 1 Alternate Delegates to State Convention ed out to you Calculations based on RPT Rules while taking into account the cap of delegates & alternates

35 Conventions A MAJOR function within the Party Precinct Convention
Each County determines when and where to be held Must be AFTER polls close on March 1, 2016 County/Senate District Convention – March 19, 2016 County Convention – if the County is entirely in ONE State Senate District Senate District Convention – if the County has more than one State Senate District State Convention – May 12th – 14th Dallas, TX National Convention – July 18th – 21st Cleveland, Ohio

36 Who can Participate? Any registered voter in the precinct who either:
Voted in the 2016 Republican Primary Election; - OR - Signed the Oath of Affiliation This means the voter did not participate in another Party’s primary or convention process in 2016,

37 Resolutions Dos & Don’ts
WHEREAS M&Ms are delicious; and WHEREAS they melt in your mouth and not in your hand; and WHEREAS they come in an assortment of varieties that everyone can enjoy; and WHEREAS they can be personalized for any occasion; THEREFORE BE IT RESOLVED THAT M&Ms be the official state candy of Texas, and BE IT FINALLY RESOLVED that every Texan should carry a package at all times. M&Ms should be the official state candy of Texas & all Texans must carry a package.

38 State Convt. Temp Committees
Each SREC Member recommends ONE delegate for each committee. If both SREC Members agree on the same committee appointment that is who the State Chair must appoint to the committee. If they members disagree the State Chair must choose between the two recommendations. The State Chair may appoint any delegate from a SD that: Does not submit any names for consideration Submits names that are ineligible or unwilling to serve Appointments must be made within 20 days of the County/SD Conventions. Appointments are due Friday, April 8th via to Rules concerning appointments All individuals submitted must be delegates at the state convention. Alternates are not allowed to sit on committees. The individual must be willing to serve Ensure the appointee is aware of the additional time and financial commitments that serving as a committee member will incur. Their name and contact information will be posted on the RPT website Committee Chairs are appointed by the State Chair

39 State Convt. Temp Caucus Chair
Two possible methods of appointment MOST COMMON: The SREC Members appoint ONE delegate from their senatorial district If both SREC Members agree on the same appointment that is who the State Chair must appoint. If they members disagree the State Chair must choose between the two recommendations. The State Chair may appoint any delegate from a SD that: Does not submit any names for consideration Submits names that are ineligible or unwilling to serve If a Senatorial District lies solely within one county the SD Convention can submit in writing a resolution passed by the convention requesting the State Chair appoint the Permanent Chair of the last Senatorial District convention if that person is eligible and willing to serve.

40 State Convt. Temp Caucus Chair
Appointments must be made within 20 days of the County/SD Conventions. Appointments are due Friday, April 8th via to Rules concerning appointments All individuals submitted must be delegates at the state convention. Alternates are not allowed to be Caucus Chairs. The individual must be willing to serve Ensure the appointee is aware of the additional time commitment that serving as a committee member will incur. Caucus Chair Training will be at 8am on Thursday, May 12th

Can an Alternate serve as an Officer, Committee Chair or Committee Member at any level in the convention process? How many people are needed for a quorum at your Precinct Convention? Are Alternates counted in a quorum?

42 Pop Quiz You did NOT attend your precinct convention Do you still have a chance to be elected a delegate or alternate to State Convention? You were elected as a delegate to your County/SD Convention. . . Are you automatically a delegate or alternate to State Convention? Can delegates or alternates be added after the convention has adjourned?

The only way to serve as a delegate or alternate, after the precinct convention, is to be elected by the previous convention? 48 Binding of Delegates Uncommitted Withdrawals
RPT Rule 38 – “Uncommitted” is an option on the ballot and is counted in the same manner as a presidential candidate. Withdrawals If a candidate files sworn statement with RPT to withdraw, then that candidate’s delegates would become “Uncommitted” NOTE: Candidates who have made public withdrawal announcements but who have not officially withdrawn in Texas will have their delegates allocated to them as if they had not withdrawn.

50 At Large Delegates Scenario A
One Candidate 50% or more = ALL At Large Delegates Scenario B No Candidate receives a statewide majority AND more than one candidate receives at least 20% THEN only those candidates are entitled to delegates Delegates are allocated proportionally among those candidates beginning with the highest vote getter, rounding up to the nearest whole number, proceeding until all delegates are allocated.

If only one candidate receives 20% or more THEN only that candidate and the second-highest vote getter are entitled to delegates The delegates are allocated proportionally between those two candidates, beginning with the highest vote getter, rounding up to the nearest whole number. Scenario D If no candidate receives 20% of the statewide vote delegates are allocated proportionally, beginning with the highest vote getter, rounding up to the nearest whole number, proceeding seriatim until all delegates are allocated.
