Model aircraft are now referred to as ‘remotely piloted aircraft’ under Part 101, and are unmanned aircraft for the purposes of Part 102. The rules do not make a distinction between remotely piloted aircraft that are operated for commercial or recreational purposes. This position reflects the CAA’s view that the aviation-related risk posed by remotely piloted aircraft differs very little, between an aircraft that is used for recreational purposes or commercial purposes. As an example, the risk to persons or property from a small unmanned aircraft taking an aerial photograph or video is the same, whether the photograph or video is sold or retained for private use. The important aspect is that the risks to persons and property are managed in both cases.

2 rules for RPAS: - Part 101 (25kg and under) - Part 102 (operator certification) RPAS weighing between 15 and 25 kg must be constructed or inspected, approved and operated under the authority of a person or association approved for this purpose by the Director of Civil Aviation. Part 101 requires operators to obtain the consent of property owners and people that they are flying over. It is a two step requirement: First, an operator must not use airspace above people unless they have the consent of people below the flight; and Second, an operator must not use airspace above an area of property unless prior consent has been obtained from any persons occupying that property or the property owner

A shielded operation is a flight where your aircraft is within 100 m of an object that’s capable of stopping it, like a building, or a forest of trees. In a shielded operation, the aircraft must fly no higher than the top of that object. A shielded operation allows you to fly within 4 km of an aerodrome, controlled and uncontrolled, and at night.

Australia's safety laws for remotely piloted aircraft (RPA), as defined in the Civil Aviation Safety Regulations Part 101, vary whether you are flying commercially or recreationally/for fun.

As part of the amendments to Part 101 coming into effect from the 29 September 2016, we will create an excluded category of remotely piloted aircraft, allowing private landowners to carry out some commercial-like operations on their own land with a small RPA (2-25kg) without needing a remotely piloted aircraft operator’s certificate (ReOC) or a remote pilot license (RePL).

From 29 September 2016, commercial operators flying very small RPAs, weighing fewer than two kilograms, will not require an ReOC or an RePL. Operators will only have to provide one notification to CASA at least five days before their first commercial flight and operate by the standard operating conditions. An operator flying a medium RPA in the excluded category must hold an RePL.

From the 21st December, drone registration is mandatory in accordance with the Small Unmanned Aircraft (Drones) and Rockets Order S.I. 563 of All drones over 1kg must be registered. Model aircraft and drones are both considered small unmanned aircraft and the same rules apply to their operation. These rules are contained within in the Small Unmanned Aircraft (Drones) and Rockets Order, 2015 (SI 563 of 2015).

The regulations apply EVERYWHERE in Irish airspace
The regulations apply EVERYWHERE in Irish airspace. Be advised that there may be privacy or trespass laws or other legal issues that should be taken into consideration by the person operating the drone. These rules are not within the remit of the IAA. You do not currently need a qualification to operate a drone provided you do so within the limits set in the Small Unmanned Aircraft (Drones) and Rockets Order, 2015 (SI 563 of 2015). However, the IAA recommends that everybody who intends to operate a drone undertake a course of safety training.

You do not need permission from the IAA to use drones commercially. However, if you wish to fly your drone outside the limits prescribed in the regulations you must apply for a specific operating permission from the IAA.

Categories of UAS Section 1 UAS activities are subdivided into the following categories: Category 1A: Unmanned aircraft with maximum take-off weight of less than or equal to 1.5 kg, which develops a maximum kinetic energy of 150 J and is flown only within the visual line of sight of the pilot. Category 1B: Unmanned aircraft with maximum take-off weight of more than 1.5 kg but less than or equal to 7 kg, which develops a maximum kinetic energy of 1000 J and is flown only within the visual line of sight of the pilot. Category 2: Unmanned aircraft with maximum take-off weight of more than 7 kg which is flown only within the visual line of sight of the pilot. Category 3: Unmanned aircraft which is certified to fly and be controlled beyond the visual line of sight of the pilot.

Competence requirements
Section 21 A UAS pilot shall have completed UAS training approved by the Swedish Transport Agency or have carried out the theoretical training for a commercial pilot licence (CPL) and achieved an approved result. An approved IR rating is required for IFR flight. Section 22 A pilot shall have completed training and achieved an approved result for the type of UAS system he or she shall fly. The training may, to a certain extent, be carried out in a simulator. Section 23 The pilot shall continually maintain his or hers system competence updated.

Medical requirements Section 24 A UAS pilot shall, at least, hold a current medical certificate class 3 according to the Swedish Transport Agency’s regulation (LFS 2008:2). Age requirements Section 25 A category 3 system pilot must be at least 21 years of age. A category 3 system pilot may not be older than 67 years of age.
