3 Background Summer 2013: TUSD submits Magnet Plan : TUSD develops Comprehensive Magnet Plan (CMP) Summer 2014: Board adopts CMP; Plaintiffs request R&R Dec 2014: SM files R&R on CMP (TUSD/Mendozas object) Jan 2015: Court partially adopts R&R…

4 Background Per the Jan 2015 Court Order:
TUSD must develop a revised CMP by May 2015 TUSD must develop improvement plans with bench marks for attaining magnet status by SM must monitor compliance and file reports re improvement plans and benchmarks SM “may” recommend eliminating a magnet school or program or recommend a school be given more time

5 Background Spring 2015: SM files a magnet monitoring schedule: Integration: schools must have no more than 70% of a given race or ethnicity and no less than 15 percentage points of the white student population at each of the three grade levels. This percent goal shall be set at the averages through This information shall be shared with the Plaintiffs and the Special Master no later than the 50th day of the school year. Data reported will reflect the 40th day enrollment data.

6 Background TUSD must file final CMP and revised improvement plans
May 2015: TUSD submits Revised CMP Summer 2015: Plaintiffs object to Revised CMP; SM files R&R Fall 2015: Court adopts R&R (and Magnet Stip): TUSD must file final CMP and revised improvement plans TUSD must develop transition plans by May 2016 SM must continue monitoring, including “his responsibility to recommend eliminating a school or program” Winter 2016: TUSD submits final Revised CMP and revised Improvement Plans

September 2016: SM files notice of intent to file on November 14, 2016: SM files recommendations to eliminate magnet status at: Ochoa Robison Utterback Safford Cholla Pueblo

December 15, 2016: Parties may respond [within 30 days] RECOMMENDATIONS ARE NOT FINAL UNTIL ALL PARTIES AGREE OR PARTIES RESPOND, SM REPLIES, JUDGE RULES December 30, 2016: SM must reply [w/i 15 days of response]

WHAT ARE THE RAMIFICATIONS? Application Process All six schools will be listed as magnets on the application until further notice Application will include the following (or similar) language: “Magnet schools and programs are subject to modification. Parent/guardian will be informed immediately if such modification impacts the choice of schools/magnet programs.”

WHAT ARE THE RAMIFICATIONS? Enrollment / Transportation USP permits students to continue to the highest grade in the school: “Subject to its decisions, if any, to withdraw or relocate magnet school status or programs, the District shall allow all students currently enrolled in a magnet school or program to remain in that program until they complete the highest grade offered by that school.” There may be precedent for “grandfathering” transportation benefits to students but not guaranteed

WHAT ARE THE RAMIFICATIONS? Funding / Transition Plans Court has ordered: “If some continued funding [in transition plans] is to use 910G allocations, the purposes of the funding shall be consistent with the provisions of the USP” Current transition plans state: “If magnet status is withdrawn in the fall of 2016 because your school does not meet the integration criteria, this transition plan will allow you to jumpstart efforts to improve academic performance for students who are not achieving at high levels.”

WHAT ARE THE RAMIFICATIONS? Funding / Transition Plans Current transition plans state: “If your school is designated in to lose its magnet status, you will then submit a more developed and detailed Transition Plan that would be implemented in the SY.” *Dr. Trujillo and Ms. Acevedo will guide the development of revised, detailed Transition plans

WHAT ARE THE RAMIFICATIONS? Funding / Transition Plans Excess funding: will be used to strengthen existing magnets and/or to fund new magnets

14 Next Steps Meet with Dr. Trujillo and Ms. Acevedo to develop detailed transition plans Legal will present this information to the Governing Board tomorrow Deseg/Finance will discuss potential budget changes with the SMP on November 29-30
