Empanelling Process of selecting 12 jurors
Selection committee headed by Sheriff starts with citizens more for controversial Names put in barrel at start of trial and citizens selected randomly Judge can excuse any hardship cases, personal interest in case, or relationship with trial participant Empanelling can take many days Not appearing for jury duty, citizen can be issued a warrant and criminally charged Companies have to provide time for jury duty

Jury Duty Prohibited: 1. Discuss case except with other jurors
2. Follow media reports regarding case 3. Disclose information about jury discussions not revealed in open court Most juries go home at end of day Sequestered – during verdict deliberations or entire trial Not a walk in the park – hard to pick juries because it can place hardship on people, most trials 15 to 20 days Jury is housed and fed until end of trial and cannot communicate with anyone except other jurors Prevent jurors from being influenced by outside interests

Why are there Challenges?
Crown and Defence want to win need citizens that are sympathetic to their case or at best neutral. Want to eliminate any jurors might be hostile to their client. Adversarial system.

Simulation Activity Scenario: Major Fraud
Accused on trial for bilking senior citizens of 500K using sophisticated Ponzi scheme Accused is 54 year old Entrepreneur Defence Council reviews jurors and picks one that would be more sympathetic to accused Ask the Jurors if they have ever lost money in an investment.

Activity Students in pairs, review at scenario 4 from last class.
As the Defence, based on the 12 juror profiles provided in worksheets, i)What question would you ask potential jurors? ii) Explain which juror would you pick for your client’s trial Reminder: Defence looks for jurors that are best sympathetic to the accuse, at least neutral, and worse eliminate potential jurors that are hostile.
