Legislative Authority to Remove Pollution Sources
Chapter 40, Texas Natural Resources Code “A person may not leave or abandon any structure or vessel in or on coastal waters if the structure or vessel is in a wrecked, derelict or substantially dismantled condition and is involved in an actual or threatened oil discharge, threat to public health safety or environment or a navigational hazard” The Land Commissioner, after complying with notice and hearing requirements, may remove and dispose of or contract for the removal and disposal of any vessel or structure The vessel may be removed immediately when an actual or threatened discharge occurs TGLO receives NO legislative appropriation for the removal of derelict vessels

Paving the Way for Removal Partnership Efforts
2003 TGLO implements a documentation process and registry for derelict coastal vessels. 2005 TGLO receives authorization (House Bill 2096) to remove vessels along the Texas coast, eliminating navigational hazards and pollution sources and allowing hundreds of vessels to be removed using federal grants and Stafford Act funds. No state funding is allocated. 2014 TGLO implements a structured education and outreach program to coordinate existing removal options.

Texas Parks and Wildlife Department Galveston County Texas General Land Office Oil Spill Prevention and Response In 2014, three agencies created the first VTIP partnership VTIP: Three Simple Goals Reduce the number of derelict vessels in and near coastal waters Demonstrate quantifiable cost savings for each participating agency No costs and no questions for voluntary participants Using a multi faceted approach, the team developed strategies focusing on highest and best use of each agency’s available resources: Galveston County – Heavy duty road and bridge equipment for crushing relinquished vessels TPWD – Boat title verification and resolution, value determination and an expedited preclearance procedure TGLO – Trailers and winches for pulling and hauling vessels as well as funding for fuel disposal, marketing, press coordination and promotion efforts

Initial VTIP Event Results
Total Event Cost = $6, ($4,500 fuel removal + $,1500 landfill fees) 26 vessels relinquished (1 additional located on county property) Total length = 478 feet ($12.55 per foot) Comparison: VTIP surrender cost for a 20’ boat is approx. $250 Private contractor cost for a 20’ boat removal is approx. $4,000
