Board of Education Policy 2412 SCC Waivers and Exceptions
Designed to enhance flexibility in order to facilitate school improvement. Aligned with the school’s Academic and Financial Plan (AFP). Demonstrates how it will improve student learning and increase student achievement. Reflects a consensus of the school community.

SCC Waivers and Exceptions
Waivers granted from: BOE Policy DOE Rules, Regulations or Procedures Exceptions granted to: Specific provisions of labor agreements to which the Board is signatory. SCC Waivers and Exceptions cannot be granted from the law.

Planning for a Waiver or Exception
Review school data with staff and school community to gather input on priorities. Create timeline and plan activities (AFP). Utilize available resources and time for collaborative discussions and shared decision-making. Determine how the Waiver or Exception support the AFP with a focus on school improvement and increasing student achievement.

Collaborative Decision-Making Process
Summary of discussions and activities documenting a collaborative and consensus-building decision-making process. SCC Waiver/Exception Signature Page: SCC members review and sign acknowledging that the decision to request was reached through a collaborative process. Complex Area Superintendent reviews and signs acknowledging that the request aligns with the goals and objectives of the school’s strategic/academic and financial plan. HSTA Process Check Requirement for an Exception: Consensus or Secret Ballot vote of 66 2/3 for approval. Inform UniServ Director by .

Requests presented to SCC Exception Review Committee for recommendation. HSTA Exception Review Committee: 2 HSTA Union members 2 BOE members HGEA Exception Review Committee: 2 HGEA Union members

Approval Process (continued)
BOE representatives from the SCC Exception Review Committee present requests to the Full Board for approval. School administrator or CAS may be present at BOE meeting for questions.

Approval Process The request for waivers and exceptions are submitted to the SCLB Office for review. The requests are then submitted to the committee. The committee consists of two representatives from the Board of Education, HSTA and HGEA, and the Chief Negotiator and a representative from SCLB office. The purpose of the committee is to review the requests from schools. The committee recommends approval of the requests to the full BOE. SCLB Office will inform the schools of the action taken by the BOE.
