1 Warm-up Do you think poor people and rich people are treated the same when they commit a crime? Why is it important to have a good lawyer?

2 Objectives Students will be able to prepare to the HSA by completing several practice questions and analyzing multiple choice strategies. Students will be able to examine the significance of Gideon v. Wainwright in providing accused persons with legal counsel by analyzing film clips.

4 HSA Practice Take 10 minutes to complete the HSA Practice.
Be sure to explain why each answer you chose was correct/how you came to that answer.

5 Due Process Substantive = substance of due process (what the laws mean) Procedural = procedures (how the laws are carried out)

6 Scenario A young man, named Joe, is walking towards the store to purchase some milk. He is 17 years old, wearing a long black t-shirt and baggy jeans. As he turns the corner of his street, a young black male wearing a long black t-shirt runs out of a liquor store and smacks straight into Joe. As he does so some blood is smeared on Joe’s shirt. The criminal keeps running. Joe panics and starts running in a different direction. He gets picked up by the police who claim witnesses saw him rob the store and shoot the clerk.

7 Class Discussion Do you think he will go to jail? Why or why not?
If you were Joe what steps would you take to help prove your innocence? If Joe was poor, why would he be at a disadvantage? Would Joe get a fair trial?

8 6th Amendment In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defence.

9 Gideon vs. Wainwright Read through the facts of the case, the question, and the conclusion. Then, answer the three questions at the bottom.

10 Gideon’s Trumpet While watching the clips, be sure to answer the questions on your worksheet. I will be collecting this at the end of class.
