2 Rend Lake College Sexual Assault Policy
The College is committed to fostering a climate free from sexual assault, sexual misconduct, stalking and relationship violence through clear and effective policies, awareness and prevention measures, prompt and equitable procedures for resolution of complaints that are accessible to all and prompt reporting of complaints and outcomes. This policy applies to all members of the College community, including students, faculty, staff, administrators, board members, vendors, and visitors.

5 Sexual Assault defined as any nonconsensual sexual act proscribed by Federal or State law, including when the victim lacks capacity to consent.

6 Sexual Harassment defined as unwelcome sexual advances, requests for sexual acts or favors, and other verbal, non-verbal or physical conduct of a sexual nature.

7 Domestic Violence includes asserted violent misdemeanor and felony offenses committed by the victim’s current or former spouse, current or former cohabitant, person similarly situated under domestic or family violence law, or anyone else protected under domestic or family violence.

8 Dating Violence means violence by a person who has been in a romantic or intimate relationship with the victim. Whether there was such relationship will be gauged by its length, type, and frequency of interaction.

9 Stalking means a course of conduct directed at a specific person that would cause a reasonable person to fear for her, his, or others’ safety, or to suffer substantial emotional distress.

10 Retaliation refers to any acts, threats, or attempts to discourage a person from reporting prohibited conduct or participating in the investigation or hearing process.

11 Consent defined as voluntary, positive agreement between the participants to engage in specific sexual activity.

12 Incapacitation means a person is incapable of giving consent due to the person’s age, use of drugs or alcohol, or because of an intellectual or other disability which prevents the person from having the capacity to give consent.

13 Preponderance of Evidence
defined as just enough evidence to make it more likely than not that the act in question was more likely to have happened than not have happened.

14 What To Do: If an individual (student, staff, visitor) is a victim of a sexual assault, the first priority should be to get to a place of safety. Report the crime to College safety and security authorities who will help the victim get necessary medical treatment. College safety and security authorities will inform the victim of the options regarding prosecution and will assist in seeking assistance from outside support agencies.

15 Bystander Intervention
In instances of sexual assault, a bystander may be able to intervene and prevent harm to others. A bystander should notice and recognize the event as a risky situation, take responsibility for helping the situation, ask for assistance from other bystanders, call 911, record any details as soon as possible, and intervene in a safe and sensitive manner.

16 Right To Know As required by law, the annual security report for Rend Lake College is available at the following link: The report addresses the policies, procedures, and programs concerning safety and security for Rend Lake College as well as statistics for certain types of crimes that were reported to have occurred on campus, in or on off-campus buildings or property owned or controlled by the school and on public property within or immediately adjacent to the campus. A paper copy is available from the Rend Lake College Police Department located in the Student Center.
