Two IRs have been published in the Official Journal: Common Requirements (EC 2096/2005) - entered into force on 24 Dec 2005 All ANSPs to be certified by 24 Dec 2006 Flexible Use of Airspace (EC 2150/2005) - entered into force on 13 Jan 2006 Enforces the application of FUA concept

Three IRs have been agreed by the SSC: Airspace Classification - agreed in October 2005 Class C airspace above FL195 wef 1 July 2007 Initial Flight Plan - agreed in December 2005 Procedures for the submission of flight plans Co-ordination and Transfer - agreed in December 2005 Requirements for the automatic exchange of flight data

Twelve IRs still under development: Charging Interoperability (Six IRs) Route and sector design Performance Review Air Traffic Flow Management Safety: risk classification scheme ESARR 1

7 Single European Sky - Update
The Charging regulation: Regulation applies to ANS providers and NOT airports unless they self-supply ANS. BUT States may opt to exclude ANSPs at airports with less than 50,000 movements per year and/or airports with less than 150,000 movements subject to passing contestability test. For the UK, this would mean Heathrow, Gatwick, Manchester, and Stansted plus any others which fail the contestability test. Exemption policy remains unchanged. Commission likely to seek opinion of SSC in September 2006.

Interoperability Mandates Flight Message Transfer Protocol not yet agreed in SSC, awaiting decision on Eurocontrol specification. Data Link services, Air-Ground Voice Channel spacing and Aeronautical Data Integrity nearing completion by Eurocontrol. New mandates on Surveillance Requirements and Mode S interrogator code allocation issued to Eurocontrol in March. The airspace regulation requires the EU member States to work towards creating a single European Upper flight information Region. To harmonise airspace classification in the EU to restructure the upper airspace to remove national boundaries by establishing large ‘functional airspace blocks’ based solely on operational traffic flows – I’ll come back to this later, and to ensure the uniform application of the flexible use of airspace concept – that is that airspace should not be designated as purely civil or military, but should be made available for all users to the maximum extent possible. .

Other Implementing Rules: ESARR 1 – Transposition of ESARR 1 into Community law under discussion in SSC Route and sector design – Eurocontrol due to report to EC by end of this month. Performance Review – IR under development by Eurocontrol. Draft to Commission by February 2007. Air Traffic Flow Management – IR under development by Eurocontrol. Draft to Commission by March 2007 Safety: risk classification scheme – mandate issued to Eurocontrol in March 2006 for completion by March 2008.

ATCO licence Directive 2006/23/EC agreed by Council and Parliament on 5 April 2006 Work underway with CAA to transpose directive into UK domestic legislation

12 Single European Sky ATM Research (SESAR)
Project definition phase PD phase is now firmly underway following kick-off meetings in Eurocontrol (6/7 March) for consortium members and in Geneva (28 March) for external stakeholders. The next milestone is 7 July 2006 – analysis of the current air transport situation Consortium website All EU Member States are required to develop a Functional Airspace Block. The intention is for airspace to be managed as a whole without the problems caused by national boundaries and different service providers. The UK has been considering what we should do and after much thought we are engaged in discussions at national level, service provider level and regulator level with the Irish. But much work remains to be done on this. In the meantime we are co-hosting a conference on FABS next January. SESAME is a very large project aimed at delivering the full interoperability of the European air traffic network using emerging technologies and the Galileo satellite system. The Commission and Eurocontrol are sponsoring a 60 million euro project taking 2 years to define what SESAME should look like. This work is due to start in the next few weeks. It will then form the basis of a large project costing several billions of euros to implement the new system to 2020 and beyond. We are expecting a Commission Communication on SESAME shortly and are hoping that it will be discussed at the December Transport Council. Finally, we are also expecting new regulatory proposals from the Commission next year on such issues as the extension of Single Sky to the lower airspace and the creation of the Upper Flight Information region.

13 Single European Sky ATM Research (SESAR)
Establishment of a Joint Undertaking Negotiations to finalise the draft Council regulation for the establishment of a Joint Undertaking are underway in the Council working group on aviation. Austrian Presidency is looking for political agreement at the June Transport Council UK concerns over the role and scope of the JU are not shared by other MS Funding arrangements now much clearer – no possibility of a levy on airspace users Role of Eurocontrol still to be clarified

PRC report for the calendar year 2005 PC agreed to disband the Regulatory Committee Extended PC President’s Bureau PC President’s Bureau has been extended to include industry representatives Efforts are continuing to try to define a roadmap towards the future European ATM A workshop for Member States will be held at Eurocontrol on 6 July 2006
