3 Chapter 27: Environment TRANSPOSITION The Law on Waters (Official Gazette of the Republic of Montenegro 27/07) is the document into which a part of the Directive has been transposed. 4 Chapter 27: Environment TRANSPOSITION Article 2 stipulates that, for the purposes of this Directive, the definitions laid down in Article 2 of the Framework Directive on waters 2000/60/EC shall apply. Those definitions of surface water, ground water, inland water, water body, river basin, good ecological status, etc. have been transposed into Articles 5 and 58 of the Law on Waters (Official Gazette of the Republic of Montenegro 27/07), which provide definitions of those terms, prescribes that quantity and quality parameters of waters shall be monitored for the purpose of using and protecting surface and ground waters, and makes the Hydro-meteorological and Seismological Office competent for it. 5 Chapter 27: Environment TRANSPOSITION Article 3.1 stipulating that, in accordance with Article 1 of this Directive and Article 4 of Directive 2000/60/EC, Member States shall apply the Environmental Quality Standards (EQS) laid down in Part A of Annex 1 to this Directive for bodies of surface waters, has been transposed into Article 73 of the Law on Waters (Official Gazette of the Republic of Montenegro 27/07) M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT

6 Chapter 27: Environment TRANSPOSITION protection, improvement and recovery of all surface waters; prevention or restriction of introduction of polluting substances into ground waters and prevention of deterioration of all bodies of ground waters; alignment with defined standards and objectives for particular protected areas The Article 73 of the Law on Waters (Official Gazette of the Republic of Montenegro 27/07) defines objectives of the protection of waters in the area of environment: M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union Chapter 27: ENVIRONMENT

7 Chapter 27: Environment TRANSPOSITION Following amendments to the Law on Waters (planned to be done in 2015) and adoption of adequate implementing legislation, the remaining part of the Directive will be transposed into the national legislation. The Ministry of Agriculture and Rural Development adopts the proposal for the Programme on systematic examination of quality of surface and ground waters, which is harmonised with the following directives: EU Water Framework Directive (2000/60/EC) Directive on pollution caused by certain dangerous substances discharged into the aquatic environment of the Community (2006/11/EC) Directive concerning the quality required for surface water intended for the abstraction of drinking water (75/440/EEC, 80/778/EEC, 79/869/EEC and 91/692/EEC); Shellfish Water Directive (2006/113/EEC/, 91/692/EEC) and Bathing Water Directive (2006/7/EEC). With a view of assessing the quality of water eco-system and examining the contents of substances from the list of prohibited or restricted substances in the water, the Programme on examination of quality of surface and ground waters has been harmonised with : Directives 86/280/EEC; 88/347/EEC and 90/415/EEC Lists I and II of Directive 2006/11/EC referring to sludge, sediment and water organisms specific for the concerned area. The Programme, at the proposal of the Ministry of Agriculture and Rural Development, is adopted by the Government of Montenegro at the annual level. Article 58 of the Law on Waters stipulates that quality and quantity parameters of waters shall be observed and monitored for the purpose of using and protecting surface and ground waters. The Hydro-meteorological and Seismological Office of Montenegro monitors the surface and ground waters at the annual level, in accordance with the Programme on examination of quality of surface and ground waters. 12 Chapter 27: Environment IMPLEMENTATION Examination of the quality of waters is aimed at determining the class and rating of surface waters, their categorisation and quality assessment, in comparison with the prescribed quality level defined by the Decree on categorisation of waters in Montenegro (Official Gazette of the Republic of Montenegro 2/07). The report on the quality of waters is used for : drafting the Report on the state of Environmen in Montenegro, prepared by the EPA and the Ministry of Sustainable Development and Tourism drafting the Report for the European Environment Information and Observation Network EIONET, prepared by the Environmental Protection Agency.
