3 Existing vs. Proposed Existing statute covers
Tattooing Scarification Branding Proposed statute will add Body Piercing. It also more clearly defines Branding.

4 Proposed Body Art Definitions
Body art – Procedures conducted for aesthetic purposes to the human body that include body piercing, branding, scarification, and tattooing. Body piercing – The puncturing of the skin by needles or other similar instrument to insert removable jewelry. The term does not include the puncturing of the external part of the earlobe.

5 Proposed Body Art Definitions
Branding – The creation of a permanent mark on the skin by burning with a hot iron or other similar instrument. Scarification – The creation of a permanent mark on the skin by scratching, etching, or cutting. Tattooing – The inserting of permanent markings or coloration upon or under human skin through puncturing by use of a needle or any other method.

6 Other Proposed Changes
Violations – A violation of this Part is a Class A1 misdemeanor. (Previously it was categorized as just a misdemeanor under G.S. 130A-25.) Limitation – A permit issued pursuant to this Part does not authorize a person to perform the following acts: -(3) Insert an object under the skin.

7 Subdermal Implants What are they?
A subdermal implant refers to a body modification that is placed underneath the skin, therefore allowing the body to heal over the implant and creating a raised design. Such implants fall under the broad category of body modification. Subdermal Implanting – Was included in 1st version of HB 250 – the current Proposed Committee Substitute has removed it from the definition of body art.

24 Impact of HB 250 Estimated to be 750+ body piercers in existing tattoo establishments Stand alone body piercing will need to be visited and educated Jewelry stores, Claire’s Boutiques, Piercing Pagodas will need to be educated – they will need permits (and facilities to meet the rules) if they are piercing anything other than ear lobes.

25 Impact of HB 250 Fees – collected by the county, kept by the county.
Tattoo Annual Permit Fee – Averages $225 - $250 across the state. Questions
