This is particularly useful in resolving or coming to an understanding of a complex case. Management meeting - Managers and HR discuss a case with the OH doctor or nurse prior to and post assessment to update our practitioner on any issues. Advice on referring – Support on the questions to ask on the referral. Occupational Health (OH) provides advisory services relating to health and work. We aim to support management, human resources (HR) and the employee through the sickness absence process and promote workplace wellbeing. GENERAL GUIDANCE Consent - Employees are given an opportunity to view their report if they wish to do so before it is released to management and HR. The Access to Medical Reports Act 1988 gives individuals the right of access to medical reports relating to them. The employee is entitled to see the reports and be given the opportunity to correct any factual errors before it is supplied to a third party. Employees are given 5 working days to contact occupational health to provide consent to release their report or withdraw consent. Failure to contact OH within 5 working days would be viewed as consent being withdrawn and management and HR would be informed. Extensions may be considered under extenuating circumstances. Request for an extension should be discussed with the consulting OH doctor or nurse at the assessment and approved by management. If consent is withdrawn managers and HR could proceed with the process (if any) with the information available to them. Adjustment - The occupational health doctor or nurse may recommend adjustments in their report for management/ HR to consider. It is under the manager’s duty of care to consider the recommended adjustments and decide whether they are reasonable for their service area. Phased Return - The timescales for phased return is generally from 1 to a maximum of 4 weeks. An extension may be considered for appropriate cases of ill health for example if the employee’s condition falls under the Equalities Act The decision on whether the phased return is suitable for the service area is a management decision. Confidentiality - Occupational health are bound by the General Medical Council and the Nursing and Midwifery Council confidentiality guidelines. Occupational health would be unable to release any medical information without the employees consent. GP / Specialist Report – The occupational health doctor and nurse may contact the employee’s GP or specialist to request further medical information with the employees consent. General practitioners and specialists take 3 – 8 weeks to respond to this request. Employees have the right to view this report before it is released to OH, this may cause further delays. If the delay in waiting for this information is significantly impacting your service area or the ability to make an employment decision managers/ HR are advised to contact occupational health. EMPLOYEE GUIDANCE Why has an appointment been made for me? Your manager has referred you for one of the following reasons; you have met the 8 day sickness absence trigger long term / intermittent sickness absence you have a condition which may affect your ability to undertake your duties at work any other concerns Your manager should have discussed the referral with you and provided you with a copy. Do I have to attend my occupational health appointment? Yes, it is a management instruction to attend your OH appointment. Please note your manager has a duty of care and responsibility to comply with health and safety laws. By refusing to cooperate with the process you may prevent your employer from taking appropriate steps to protect you and other employees. Rescheduling your occupational health appointment Your are given an opportunity on the referral to inform OH the times and dates that you are not available. We will try to book an appointment at a time that you are available. If you have to reschedule please inform your manager and contact occupational health. Repeated cancellations will result in you being discharged from the clinic and may be considered as a disciplinary matter. MANAGER’S GUIDANCE My question has not been answered on the occupational health report / I need further advice from the occupational health doctor / nurse. If you have outstanding queries please contact occupational health by setting out specific issues requiring clarification. Background information and specific questions It is important that manager’s provide background information on the referral. This is essential to undertake the assessment. Please ensure that only relevant questions are selected on the referral. Please insert further questions if the standard questions on the referral do not address your concerns. The occupational health doctor and nurse will make every effort to answer every question you have asked. If you would like advice on what questions to ask please contact occupational health.
