Section 1: Understanding the Constitution
Describe how the framers balanced state and federal powers List and describe the three branches of the federal govt Analyze the division of power among the three branches of govt What might happen if nobody but the president made, enforced, and interpreted the nations laws?

Federal courts divided into three levels Lower courts- district court Next level- court of appeals Top Level- Supreme court Supreme Court- 9 members- final say- usually answer constitutional questions about the law

Section 2: The Bill of Rights
Discuss freedoms listed in the 1st Amendment Identify the amendments that reflect Revolutionary issues Examine the rights that the Amendments provide to people accused of a crime What rights do you possess as a US citizen?

A. The First Amendment Bill of Rights- First ten amendments to the constitution Compiled by James Madison 1st Amendment- religion, speech, press, assembly, petition Slander? Libel? Peter Zenger? Petition?

B. Protecting Citizens 2nd, 3rd, and 4th amendments grew out of disputes with GB 2nd- the right of people to keep and bear arms 3rd- prohibits forcing citizens to house soldiers 4th- no unreasonable search and seizures Need search warrants

C. Protection of the Accused
Amendments 5-8 provide protection for the accused Due Process- 5th- must be evidence to indict- or formally accuse Plea the fifth? Double Jeopardy? No one will be deprived of property without ”due process” Exemption- eminent domain?

6th amendment- must have prompt, public trial by jury Right to know the charge Hear the evidence Attorney 7th- Juries can decide all Civil Cases 8th- reasonable bail No cruel and unusual punishment

10th – power not specifically given to federal government is given to the states

Section 3: Rights and Responsibilities of Citizenship
Describe the Citizenship process Identify important responsibilities Identify the importance of community involvement What does it mean to be a US citizen? What rights do you have? What responsibilities do you have?

A. Becoming a Citizen Born in US or territories are automatically citizens Naturalization- INS- Immigrants must go through citizenship process to gain full rights Live in US 5 years Law abiding Tests- read, write, and speak English Basic Understanding of govt and history Oath of Allegiance

B. Duties Obey Authority Pay Taxes Serve in military Social Contract
Know the laws Respect authority Pay Taxes Needed to run a country Serve in military Men have to sign up for draft at 18

Must show up if called for jury duty Elections Be informed Participate in PACs Participate in campaigns Join interests groups Volunteer and be members of the community
