5 Bureau of Radiation Safety Regulation (BRSR) ;
Responsibility 1.To perform radiation safety regulation and law enforcement 2.To carry out inspection, evaluation, licensing and coordinating of matter related to radiation safety 3.To coordinate with organizations in Thailand and abroad on radiation emergency preparedness 3.To coordinate with organizations in Thailand and abroad on radiation emergency preparedness

6 Legal and Regulatory Framework
The Atomic Energy for Peace Act, BE 2504 (1961) The Atomic Energy for Peace Act (No.2),BE 2508 (1965) - License approved by Nuclear committee - No Exemption Level, So HDSS and LDSS must have license, same procedure to applied license -Regulations cover only x ray machine not include another radiation machine ( Cyclotron ,Synchrotron) - Have not Transit License - Penalties don’t correspond to Current situation and economic conditions Bureau of Radiation Safety Regulation, OAP (Thailand)

7 Legal and Regulatory Framework
NUCLEAR ENERGY FOR PEACE ACT, B.E (2016) aims to ensure the peaceful use of nuclear energy. The Nuclear Act enforce on 1st February 2016. The ministerial regulation is under progress of legislation 51 issues. Bureau of Radiation Safety Regulation, OAP (Thailand)

8 Legal and Regulatory Framework
Topic of NUCLEAR ENERGY FOR PEACE ACT, B.E (2016) definition Powers and Duties of Nuclear commission Regulation of Radioactive Material Regulation of Radiation Machine Regulation of Nuclear Material Regulation of Nuclear Facility Reasonability of Licensee Penalty Bureau of Radiation Safety Regulation, OAP (Thailand)

9 definition “Radioactive material" means any element or compound whose a component of its atomic structure is unstable and decays by releasing radiation, either existing in nature or created from a production or use nuclear material, from a production by a radiation generator, or from any other processes, not including radioactive material with a characteristics of nuclear material “Radiation generator" means a machine or a system of devices, when energized, produces radiation, including a component as prescribed by the Ministerial Regulation, which is used in assembling a radiation generator which cover e-beam ,Cyclotron, Synchrotron

10 NUCLEAR ENERGY FOR PEACE COMMISSION
“The Nuclear Energy for Peace Commission” consisting of: The Prime Minister as Chairperson The Minister of the Ministry of Science and Technology as Vice Chairperson Ten ex officio members consisting Six qualified members appointed by the Council of Ministers from exert persons The Secretary General of OAP Bureau of Radiation Safety Regulation, OAP (Thailand)

11 NUCLEAR ENERGY FOR PEACE COMMISSION (Cont.)
The Commission shall have the following powers and duties: To propose policies and recommendations of the use of nuclear energy also nuclear and radiation regulation for safety To advise the Minister on issuing the Ministerial Regulations under Nuclear energy Act To specify rules and oversee compliance with the terms or conditions in a license issued under this Act To develop specific standards on nuclear energy to promote and disseminate the knowledge on nuclear safety Bureau of Radiation Safety Regulation, OAP (Thailand)

12 Principles of Regulatory Supervision
Radioactive Material Nuclear Material Radiation Generators Bureau of Radiation Safety Regulation, OAP (Thailand)

13 REGULATION OF RADIOACTIVE MATERIAL
Applying for a license, register and notice or Exemption for each type of radioactive materials shall be in accordance with the rules, procedures, and conditions prescribed by the Ministerial Regulation. Category Of RM Level of Regulation 1. Extremely Dangerous 1. Exemption follow by GSR Part 3 2. Very Dangerous 2. Notice 3. Dangerous 3. Licensing 4. Unlikely to be Dangerous 5. Not Dangerous Bureau of Radiation Safety Regulation, OAP (Thailand)

14 REGULATION OF RADIOACTIVE MATERIAL
- Exemption level. Chapter III Section 18. Any radioactive material that is not under control of this Act shall be prescribed by the Ministerial Regulation, considering the activity level and the nature of possession or use of the radioactive material. Radioactive activity Lower than Clearance level Follow BSS No.115 Bureau of Radiation Safety Regulation, OAP (Thailand)

15 REGULATION OF RADIOACTIVE MATERIAL
-Notice level. Chapter II Section 20. Any radioactive material that a person does not need to apply for a license under section 19 shall be prescribed by the Ministerial Regulation, considering the activity level and the usage nature. - follow Table I (most Cat 5 GSR part 3) - A/D lower than 0.01but higher than Clearance level Bureau of Radiation Safety Regulation, OAP (Thailand)

22 LICENSING FLOW CHART Applying for a license by:
e-License / Mail / walk-in 1 day Not accept Reject the document Verify the document Renew within 30days Accept Verify Safety and Security Report Safety and Security Assessment Licensed Agency Technical Check New Entry 7 days Summary of technical assessment for the working group in the Bureau 7 days Committee of the license Not accept Request of more information Accept 3 days Licensing by The Secretary Genera Radioactive Material Radiation Generators

23 E-License system E-License System was developed since 2010 by oracle
Previously, we used a program developed by a private company. And database migration to E-License ( base on Access software ) for the licensing of radiation material and radiation generator include import and export Radioactive material To applied License through the electronic system. Registry of radiation material, x ray machine Database of radiation inspection

Legal document Address map Source inventory Source Certification Radiation emergency Plan Etc…

30 IMPORT – EXPORT BY NATIONAL SINGLE WINDOW (NSW)
Applying for a license Import / Export Agency/ Trader OAP Customs One Stop Service Verify the document Assessment and Technical Check Get a License License per Invoice NSW Accept Data License per Invoice Accept Reference code Invoice and OAP Ref Code Verify Invoice and OAP Ref Code Customs Clearance Release Goods Bureau of Radiation Safety Regulation, OAP (Thailand)

31 Source inspection Licensee will sent document to RA After import or export 15 days Source Certification Export or import document Picture Licensee will send inventory of source report to RA depend on category of source notice level user will send annual report RA will send staff to inspect the site on a regular basis, depending on Cat. Of Source

32 Gap and Challenge E-License System Not designed for notice Therefore, additional system development is needed. Registering a Radiation machine is difficult due to the lack of import controls Have 2 agency to Regulatory So sometime Licensee can not separate responsibilities. M
